BACKGROUND: SP 2004 -052 was approved by the Board of Supervisors on October 5, 2005. That special use
permit allowed residential development of commercially zoned property. During the special use permit review
staff noted the need for a critical slopes waiver. The Planning Commission did not take any action on the critical
slopes waiver during its review of the special use permit. The Planning Commission did not recommend approval
of the special use permit based on"specifically: (1) internal parking, (2) stormwater management and(3)
affordability issues, as well as the issues Mr. Thomas raised about the specificity of the screening that should be
addressed at the special use permit level." Critical slopes do not appear to have been a specific issue of concern
for the Planning Commission.
DISCUSSION: The Site Review Committee has reviewed the preliminary site plan for compliance with the
zoning ordinance and the conditions of SP 2004-052 and determined that it can be approved administratively
with Planning Commission approval of the requested modification of Section 4.2.
RECOMMENDATION: Staff finds that this request is generally consistent with the criteria of Section 4.2.5a for
granting a modification and therefore is able to recommend approval to the Commission.

APPLICANT'S PROPOSAL: Request for final site plan(prior to preliminary approval) to construct 65
new dwelling units, 12 being townhouse, 48 single-family attached, and 5 single-family detached, and an
existing 3,000 square foot carriage house structure to be converted to office use,totaling 110,500 sq. ft.
on approximately 16.5 acres. Property is zoned CO(Commercial Office) and is described as Tax Map
60, Parcel 27. It is located on the north side of Ivy Road(U.S. Route 250) approximately 1-mile west of
its intersection with U.S. Route 29 Bypass. This site is located in the Samuel Miller Magisterial District
and is recommended for Office Service in Rural Area 1.
CHARACTER OF AREA: This is a site along Route 250 in an entrance corridor surrounded by a mix
of commercial, office, and residential uses. The site sits on a slope well elevated above Route 250 and
contains a variety of trees, vegetation, and 2 large buildings proposed to remain integrated within the
site.
PLANNING AND ZONING HISTORY: SP 2004 -052 was approved by the Board of Supervisors on
October 5, 2005. That special use permit allowed residential development of commercially zoned

COMPREHENSIVE PLAN: This site is recommended for Office Service uses in Rural Area 1 by the
Comprehensive Plan.
REASON FOR PLANNING COMMISSION REVIEW: This site plan shows areas of critical slopes.
As required by Section 4.2.5,the applicant has submitted a request for a critical slopes waiver
(Attachment C),which requires action by the Planning Commission,prior to site plan approval.
STAFF COMMENT: This project has been reviewed by the Site Review Committee and can be
approved subject to Planning Commission approval of a modification to allow activity on critical slopes.
REVIEW OF MODIFICATION OF SECTION 4.2.3 TO ALLOW ACTIVITY ON CRITICAL
SLOPES.
The proposed development includes activity on critical slopes. Staff has reviewed this request as
required by Sections, 4.2 and 4.2.5 of the ordinance. This review is divided into two parts, a review for
impact on aesthetic resources and a review of the engineering impacts.

Before this proposal may be approved a modification to allow critical slopes disturbance is necessary.
The request for a modification has been reviewed for both Engineering and Planning aspects.
Review of the request by Current Development Planning Staff.
This review is focused on the criteria in Section 4.2 and the potential loss of aesthetic resources.
This site is located in an Entrance Corridor, which will require additional design review. Staff believes
that the added design requirements from the Architectural Review Board will mitigate any potential loss
of aesthetic resources that could be brought about as a consequence of approval of this modification.
Further, the area of critical slopes is at a portion of the parcel not readily visible from Route 250, and it
is staffs opinion that approval of this modification will not create a negative visual impact.
Review of the request by Current Development Engineering Staff
Critical slopes make up 1.08 acres of the site's 16.5 acres, or 6.6 % of the site area. Below, each of the
f,Q;ncerns of Zoning Ordinance section 18-4.2 is addressed:
"movement of soil and rock"
Proper slope construction, control of drainage, and vegetative stabilization will prevent any movement
of soil.
"excessive stormwater runoff'
Stormwater runoff will be controlled by the drainage plan proposed.
"siltation"
Inspection and bonding by the County will ensure siltation control during construction and that the
proper vegetative stabilization will occur to prevent long term siltation.
"loss of aesthetic resource"
The entrance to the road will be visible from Route 250. The rear area should not. This is a scenic corridor and
Entrance Overlay.
"septic effluent"
This is not a concern as the site is serviced by public sewer.
Summary of review of Modification of Section 4.2
Section 4.2.5 establishes the review process and criteria for granting a modification of Section 4.2.3.
The preceding comments by staff address the provisions of Section 4.2.5a. Staff has included the
provisions of Section 4.2.5b here, along with staff comment on the various provisions (Staff comments
are in italics.)
The commission may modify or waive any requirement of section 4.2 in a particular case
upon finding that: (Amended 11-15-89)

1. Strict application of the requirements of section 4.2 would not forward the purposes of this
chapter or otherwise serve the public health, safety or welfare, or that alternatives proposed by
the developer would satisfy the purposes of section 4.2 to at least an equivalent degree; or

Approval of this waiver could forward the purpose of the ordinance by allowing development
approved by the Board of Supervisors to occur.
2. Due to its unusual size,topography, shape of the property, location of the property or other
unusual conditions, excluding the proprietary interest of the developer, the requirements of
section 4.2 would effectively prohibit or unreasonably restrict the use of the property or would
result in significant degradation of the site or adjacent proper ties. Such modification or waiver
shall not be detrimental to the public health, safety or welfare, to the orderly development of the
area, or to adjacent properties, or be contrary to sound engineering practices; or(Added 11-15-89
With the exception of a small area of critical slopes, the proposed use of this property and the
site plan are consistent with existing growth patterns in this zoning classification and should not
be a detriment to public health, safety or welfare, or to adjacent properties. Denial of this
request would not effectively prohibit or unreasonably restrict the use of the property. However,
staff does note that in order to access the property, regardless of design, some critical slopes will
have to be disturbed.
3. Granting such modification or waiver would serve a public purpose of greater import than
would be served by strict application of section 4.2. (Added 11-15-89)
Granting this modification would allow development of this parcel, which is located within the
development areas.
This analysis results in the following findings.
Factors favorable to approval of a modification to allow activity on critical slopes:
1. Limited or no visual impact to U.S. Route 250 or adjacent property,
2. Minimal impact for soil erosion.
Factors unfavorable to approval of a modification to allow activity on critical slopes:
1. No unfavorable factors have been identified.
RECOMMENDED ACTION:
Generally staff finds that this request is consistent with the critena of Section 4.2.5a for granting a
modification and therefore is able to recommend approval to the Commission of a modification of
Section 4.2.3.

Please consider this critical slopes waiver request to allow minimal impacts to critical
slopes located within the development of Kenridge.

The following are the critical slope calculations for the site: o ..

and open spaces that preserve the existing historic buildings and outstanding tree
specimens,while ensuring that road grades and drainage facilities meet engineering
standards. £
The following explanation addresses the five issues described in Section 4.2 of the e
Albemarle County Code regarding potential effects of impacting critical slopes. i
1. Rapid and/or large-scale movement of soil and rock
Critical slope impacts at Kenridge will require minor grading to achieve the
County's goals for this area. Of the total 16.55 acres within this plan area, only
0.94 acre of critical slope impacts are proposed, corresponding to under 6%of the
total project area. By general industry standards, this level of impact is not
considered large-scale.
2. Excessive Stormwater runoff
Stormwater drainage facilities shall be implemented throughout Fontaine to
conduct runoff in a manner acceptable to the County Engineer.
3. Siltation of natural and man-made bodies of water.
Open spaces will be planted to reduce erosion and minimize siltation.

Two of the existing buildings, as well as many of the existing trees at the front of the
site are considered valuable aesthetic resources. These features are being
protected to maintain this site's aesthetic value. Extensive additional planting will
be implemented to protect neighbors from undesirable views of the development.
5. In the event of septic system failure, a greater travel distance of septic effluent.
All residences at Kenridge will be served by a public sewer system, therefore septic
system failures are not a concern.
Based on the calculations and explanation provided above, the minimal critical slope
impacts requested will in no way constitute potential dangers to the public health, safety
and/or welfare.

The Albemarle County Planning Commission meets in Room 241,Second Floor, County Office Building,401 McIntire
Road,Charlottesville,Virginia,22902-4596,Tuesdays at 6:00 p.m. Because of the potentially large number of items presented
for consideration, the Commission has established certain guidelines for citizen participation (see back of this agenda for a
complete listing). These guidelines help to ensure that everyone who wishes to speak can do so, and that the Commission
can benefit from hearing as many different people as possible in the shortest period of time.
Matters generally are considered by the Commission in the order listed on the agenda. Matters on the "consent
agenda" are routine and are normally adopted or approved by one motion without discussion. Items listed on the regular
agenda are taken up one at a time. Keep in mind that the agenda is for the convenience of the Commission and the public and
the agenda can be altered by the Commission at any time without prior notice when it is considered to be in the best interest to
