ACTION: Yes INFORMATION: The property, described as Tax Map 78 -Parcel 58(I) and Tax Map 78B -Parcels 3 and 4, is zoned R-15 with proffers (ZMA ATTACHMENTS: Yes 00-10) and cover a total of 27.156 acres (Attachment B). This site is located in the Rivanna Magisterial District off of REVIEWED BY: VWC Fontana Drive approximately 1/10 mile from the intersection of Route 20 and Fontana Drive. The Comprehensive Plan designates this property as urban density in Urban Neighborhood 3. STAFF CONTACT(S): Stephen B. Waller BACKGROUND: At its July 9, 2001 meeting, the Board of Supervisors unanimously approved a Zoning Map Amendment (ZMA 00-010) for approval to rezone the subject property from R-6 to R-15 to allow a mixed-density development, which includes the currently proposed multi-family apartment complex as Phase 1. This action was taken with additional approvals of special use permits allowing the inclusion of professional office and retail commercial uses. During the Planning Commission's review of the Zoning Map Amendment, approvals of modifications to allow curvilinear parking, angled parking and one-way circulation were also granted. The preliminary site plan(SDP 02-020) for this development has been submitted for review by the Site Review Committee, and staff has determined that it can be approved administratively with Planning Commission approval of the requested waiver of Section 4.2,which restricts the disturbance of critical slopes. DISCUSSION: Critical Slopes Waiver: Section 4.2.3.2 of the Zoning Ordinance restricts earth-disturbing activity on critical slopes,while Section 4.2.5.2 allows the Planning Commission to waive this restriction upon finding that a strict application of these provisions would not forward the purposes of the Zoning Ordinance. The applicant has submitted a request and justification for the waiver, which addresses the five health, safety and welfare concerns that are set forth in the Ordinance (Attachment C). Staff has addressed those concerns both directly through the analysis provided herein, and with the standard process for administrative review that is applied to all site development proposals. According to the Engineering Department's analysis, critical slopes are spread throughout the site and cover a 1 total area equaling 2.13 acres, and accounting for approximately 9.3 percent of the total site area. The proposed forms of critical slopes disturbance varies from the construction of the buildings,parking lot and amenities to site grading and the location of stormwater management facilities. The development of this site, as shown on the site plan,would result in the disturbance of a majority of the critical slopes. Staff has reviewed this waiver request with consideration for the five concerns that are set forth in Section 4.2 of the Zoning Ordinance, entitled Critical Slopes. Because this site will be served by public sanitary sewer services,there is no concern that the proposed disturbance would increase the potential on the travel of septic effluent. The Engineering Department's analysis addresses the concerns for excessive stormwater run-off, increased movement of soil and rock, and siltation. The stormwater detention pond proposed within this phase of the development must be designed to meet the sizing requirements of the Water Protection Ordinance and prior to final site plan approval. A second, larger pond, which would be sized to detain and treat regional stormwater from off-site sources, is still in the early stages of development pending the outcome of the applicant's negotiations with adjacent property owners, and the County's ability to accept the final product as a public project. Therefore, it has been removed from the preliminary plan for this phase of the development. During construction, this site will be subject to regular inspections for adherence to an approved erosion control plan. According to the Engineering analysis, certain techniques for slope construction, drainage control and vegetative stabilization on the finished slopes will be required to properly address the concerns large-scale movement of soil and rock and siltation. Additionally, Engineering staff has recommended approval of the requested waiver with a condition requiring the stabilization all finished 2:1 slopes with a certain type of low maintenance ground cover(Attachment D). The Department of Planning and Community Development's analysis of this request gives consideration for the concern with the possible loss of aesthetic resources. Staff recognizes that none of the critical slopes at this site are delineated on the Open Space Plan Concept Map,nor are they adjacent to any Major or Locally Important Stream Valleys, or within Mountains. Although this request would result in the removal several individual trees and small groups of trees that are spread through out the site, none of the areas where the disturbance of critical slopes is proposed lie within the Buffer or Important Wooded Areas that adjoin the site. Furthermore, all construction must remain outside of the proffered 40-foot buffer and 70-foot setback that shall be maintained between this site and the single-family detached homes within the Fontana subdivision. Therefore, Planning staff finds no significant concern for the loss of aesthetic resources that would result from this request. RECOMMENDATION: With the support of Department of Engineering and Public Works, Planning staff hereby recommends approval of the requested critical slopes waiver with the following condition: All finished slopes with 2:lor greater grades shall be stabilized with low maintenance vegetative ground cover either of a variety to be selected from Table 3.37-C on page III-391 of the Virginia Erosion and Sediment Control Handbook, or an equivalent to be approved by the Engineering Department. We understand the implementation of the comprehensive plan, and offer the following conditions in response to your concerns: 1) Rapid and/or large-scale movement of soil and rock: All slopes will be hydro-seeded and protected with erosion control measures in order to prevent soil erosion until full grass growth has been established in accordance with the Virginia Soil Erosion and Sedimentation Control Manual. 2) Excessive stormwater run-off: The proposed site has multiple stormwater control measures including drainage swales, curb inlets, an on-site stormwater detention pond that will be used to control the release rate of stormwater. 3) Siltation of natural and man-made bodies of water: There is a regional water quality pond that will control any siltation caused by stormwater runoff. In addition, a sediment pond will be provided during construction to minimize sediment. 4) Public Drinking Water Supply: This site does not drain into a waterway that is a public drinking water supply for Albemarle County. We do not believe contamination to a drinking supply would be caused by this site. 5) Septic System: No septic systems or drain fields are being utilized in this project. All sanitary sewer will be dedicated to and maintained by Albemarle County Service Authority(ACSA). 6) Flood Plains: This site is located in Zone C outside the 100-year flood plain area according to FEMA Map 510006 0240B dated 2/16/80. Based on the preliminary site plan received April 16, 2002,the site has a total area of 27.156 acres. The area encompassed by the phase 1 construction is 22.96 acres. This includes an approximate cntical slope area of 2.13 acre,which is about 9.3%of the phase 1 construction area. Approximately all of the critical slope area on the subject property will be disturbed during the proposed construction in this area. About 0.79 acre,or 37%, of the disturbed critical slope area is related to the construction of two stormwater management ponds. As stated in Section 18-4.2 of the Zoning Ordinance,the following concerns must be addressed before any cntical slope waiver is granted. 1. "movement of soil and rock" Proper slope construction,control of drainage, and vegetative stabilization will prevent any movement of soil. 2. "excessive stormwater runoff' Two stormwater management ponds are proposed for this site to address stormwater quantity and quality. One of these ponds is a proposed regional pond. An erosion and sediment control plan and a stormwater management plan that meet the requirements of the Water Protection Ordinance must be submitted with the final plans for approval. 3. "siltation" Inspection and bonding by the County will ensure siltation control during construction that meets state erosion control standards. Proposed stabilization and maintenance will ensure long term stability. 4. "loss of aesthetic resource" Some aesthetic loss is expected from tree removal. 5. "septic effluent" This is not a concern, as this site will be served by public water and sewer. Based on the above review,the Engineering Department recommends approval of the critical slope waiver with the condition that all proposed 2:1 slopes must be stabilized with low maintenance vegetative ground cover. The vegetative cover must be a vanety selected from Table 3.37-C on page III-391 of the Virginia Erosion and Sediment Control Handbook or an equal approved by the Engmeenng Department.
