RE: SDP 02-020 Avemore Preliminary Site Plan
Dear Mr. Hauser:
At its November 26,2002 meeting, the Planning Commission approved your request for a waiver of the
provisions restricting the disturbance of critical slopes, in accordance with Section 4.2.5.2 of the Zoning
Ordinance, with the following condition:
All finished slopes with 2:1or greater grades shall be stabilized with low maintenance vegetative
ground cover either of a variety to be selected from Table 3.37-C on page III-391 of the Virginia
Erosion and Sediment Control Handbook, or an equivalent to be approved by the Engineering
Department.
The Department of Planning and Community Development hereby grants administrative approval of the
above-referenced site plan. In accordance with Zoning Ordinance Section 32.4.3.1, approval of the
preliminary site plan is valid for one (1)year. Therefore, this approval shall expire December 11,2003.
If the preliminary site plan approval expires before all final tentative approvals have been granted, a new
application must be filed and processed.
Please address all of the requirements and conditions listed below and submit eight(8) copies of the
tentative plan to Bill Fritz, in care of the Department of Planning and Community Development. This
letter must be submitted with the tentative plans, as a checklist, to document that you have addressed all
requirements and conditions, or the tentative plan will be denied.
The Erosion and Sediment Control Plan and the BMP Stormwater Management Plan,with the associated
applications and fees,may also be submitted with the eight(8) tentative plan copies. Failure to do so
will result in a separate application to be filed with the Engineering Department at a later date.
After the initial tentative plan submittal, each department/agency will contact you to discuss any
remaining conditions. After all aforementioned department/agencies have granted a tentative approval,
you may submit the final mylars (2 sets), one blueprint or paper copy, final site plan application, final
site plan fee ($410), and a copy of all written tentative approvals to the Department of Planning and
Community Development by 5:00 p.m. on any week day. Assuming that the site plan mylars reflect the
required conditions of all final tentative approvals, the plans will occur within one week.

The final site plan will be subject to all final site plan requirements (Zoning Ordinance Section 32.6), in
addition to the following conditions.
The Planning Department shall not accept submittal of the final site plan for signature until tentative
approvals for the following conditions have been obtained. The final site plan shall not be signed until
the following conditions are met:
A. Planning Department approval to include:
O 1. [32.7.9]Approval of complete landscape plan depicting species types,number
and location. Please note that 1 tree will be required for every ten parking spaces
and shall be placed in close proximity to the parking lot. Please ensure that the
final landscape plan is coordinated with all on site utilities and their easements
and that all requirements of the Landscaping section are addressed adequately.
O 2. [32.5.6k] Prior to approval of the final site plan, easements must be obtained
from the respective owners of adjacent property where any off-site work, utilities
and improvements are being proposed;
O 3. [32.5.6i] Prior to approval of the final site plan, land must be acquired through
easements or otherwise obtained from the respective owners of adjacent property
that any roads, entrances and/or travelways are shown to cross;
O 4. [ZMA 02-10 Proffer H]The required 8-foot wide right-of-way for a sidewalk,
across the Wilton Lots, along the frontage of Route 20 must be dedicated prior to
the approval of the final site plan;
O 5. [32.7.9.4b] A conservation plan checklist must be completed and incorporated
into the site plan to demonstrate the measures that will be implemented to protect
the existing trees to be preserved within the open space; and,
O 6. Recordation of a final subdivision plat combining the parcels that comprise this
site, or adjusting boundary lines accordingly in order to ensure that there is no
conflict with the setbacks structures,proposed on the site plan.
B. Engineering Department approval to include:
O 1. The Engineering Department still supports the concept of a regional BMP facility
on the eastern edge of the Avemore site, as this will naturally have additional
benefits for the watershed. We understand that the Planning Department is
currently considering several possible options to facilitate the regional basin. The
Engineering Department is willing to work with the applicant to achieve this
goal.
O 2. The following items must be submitted with the final site plan for review by the
Engineering Department.
O a. An erosion control plan, narrative and computations. [18-32.7.4.3, 17-
203].
O b. A completed application and fee for erosion control and stormwater
management. [17-203, 17-303]
O c. A stormwater management/BMP plan and computations. Computations
must include water quality, and detention routings for the 2yr and l0yr
• storms. [17-304]
O d. A completed stormwater management facilities maintenance agreement
and fee. [17-323]
O e. Drainage computations. [18-32.7.4, Policy]

❑ f. Retaining wall plans and computations certified by a professional
engineer for walls over 5 feet in height. [Policy]
3. VDOT approval will also be required for final site plans that affect right-of-way
C. Albemarle County Department of Building Codes and Zoning Services approval to include:
❑ 1. [4.16.3.3] A determination of interpretation for the section cited requires that the
recreation note be changed to reflect that interpretation. Please change the note on
the plan to: Recreational facilities for each sub-phase shall be completed when
50% of the units in that sub-phase have received certificates of occupancy. All
recreational facilities for the entire development must be completed when 203 of
the proposed dwelling units for this phase have received certificates of
occupancy.
❑ 2. [32.6.6(h)J Proof of legal recordation of proposed boundary adjustments.
D. Albemarle County Service Authority approval to include:
1. Final approval of construction drawings for water and sewer extensions must be
obtained. Construction drawings (3 sets) shall be submitted directly to the Service
Authority for review and approval.
F. Virginia Department of Transportation approval to include:
❑ 1. The road typical section for improvements and widening of Fontana Drive should
indicate from Route 20 to Delphi Dr. /Avemore entrance.
❑ 2. The underdrain should be labeled as Standard UD-4.
❑ 3. Milling should only be shown along the edge of the existing curb and gutter on
the north side of Fontana Drive. The 1.5" overlay will be allowed along the
median curb without milling the inside lane along the CG-2.
❑ 4. The proposed IM-1A asphalt surface grade for the widening of Fontana Drive should
coincide with the finished grade of the SM-9.5A surface installed by the Fontana
developer and the final surface of 1.5" of SM-9.5A applied over the full width of the
inbound lanes.
❑ 5. The 300'sight easement for the Avemore entrance will need to be platted and
recorded prior to final plan approval.
