RE: SDP - 2007 -150; Bonner Critical Slope Waiver
Dear Megan:
This letter is to request a waiver from the requirements of Section 4.2 of the Zoning
Ordinance. The attached sketch shows that there are areas with 25% or greater slopes
that have been disturbed as part of this project.
The total.area of existing critical slopes on TMP 76C -02 parcel 4 is approximately 9,000 SF.
The total area of critical slopes that has been disturbed for the new driveway is
approximately 750 SF. (8% of total).

Below, each of the concerns of Zoning Ordinance section 18 -4.2 is addressed:
1. "movement of soil and rock ". The construction of the driveway is already
complete and the site is stabilized. No erosion has occurred and future
movement of soil or rock will not occur if adequate stabilization is maintained.
2. "excessive stormwater run - off':• The critical slopes are scattered throughout
the site. The disturbance is away from any large sections of critical slopes
that might be prone to erosion from excess runoff.
3. "siltation of natural and man -made bodies of water ": The driveway
construction has already been completed. Proper stabilization and
maintenance will ensure long term stability.
4. "loss of aesthetic resource ". The existing critical slopes proposed for
disturbance are scattered through the site and are not part of a greenway or
an aesthetic resource.
5. "septic effluent ": Primary and reserve drain field are already present on the
lot. Additional critical slopes will not be disturbed for the construction of drain
fields.
This site does not drain into a waterway that is a public drinking water supply for
Albemarle County, nor is the disturbance within a 1 00y flood plain.
The reasons given above demonstrate that the grading of critical slopes on this project
has not been detrimental to the health, safety, and /or welfare of the public as outlined in
section 4.2 of the zoning ordinance.
