A. Erosion Control Plan
Effective February 7th, 2008, all Rural Area building permit applications were required to provide an
Erosion and Sediment Control Plan, narrative, application (Water Protection Ordinance Application), and fee,
to accompany a building permit application and plan. The County Engineer has now authorized agreements -
in- lieu -of -plans for Erosion and Sediment Control for Rural Dwellings with proposed disturbances of less
than an acre. A Critical Resource Plan is required in addition to agreement -in- lieu -of- plans. For applicants
who have submitted formal Erosion Control Plans between February 7th and now, Engineering staff are
checking the plans to see if the applicant can now submit an agreement with accompanying Critical Resource
Plan. If eligible, the County can process the previously submitted Erosion Control Plan as the Critical
Resource Plan.
Applicants who have previously submitted formal Erosion Control Plans and meet the new criteria
for submitting an agreement have two options: you can either continue to pursue the approval of the
submitted Erosion Control Plan, or withdraw the plan and submit an agreement with accompanying Critical
Resource Plan. Staff recommends submitting an agreement because the processing of the building permit
should be much timelier than submitting a formal erosion control plan.
You have previously submitted an Erosion Control Plan, and it appears you may be eligible to submit
an agreement rather than a formal Erosion Control Plan. I have reviewed the plan to verify whether or not it
meets all the requirements of a Critical Resources Plan. (See attached memo on Critical Resources Plan
requirements.) The proposed disturbance is shown to be around 1.2 acres. If the plan can be revised to disturb
one acre or less, an agreement can be submitted in -lieu of the Erosion Control Plan. If greater than an acre
must be disturbed, please address the comments sent on the 18th of March and Engineering will continue
processing the Erosion Control Plan.
If disturbance can be revised to be an acre or less, please address the following comments to the plan
and resubmit the plan as a Critical Resources Plan along with an Erosion Control Agreement to accompany
the building permit application:
1. Please label the plans "Critical Resources Plan".
2. Please show an area of disturbance of an acre or less.
3. Please resubmit the Critical Resources Plan along with an Erosion Control Agreement for Single
Family Residences application to accompany your previously submitted building permit:

4. Once an agreement has been submitted, the previously submitted Erosion Control Plan will be
withdrawn. If you would like to or need to pursue the approval of the originally submitted Erosion
Control Plan, please contact me.
