Hurt Contractors 195 Riverbend Drive Charlottesville, VA 22911 Re: Colthurst Waste Area, WP0200600065, T.M.60 -68 — appeal of WPO decision To Whom It May Concern: We are in receipt of an email dated July 10 " from Tucker Hurt to Ella Jordan, Clerk to the Board of Supervisors, appealing the decision by Glenn Brooks of the Program Authority that the above - noted permit has expired and will not be extended. This decision was made on July 8'r' via email to Tucker Hurt by an administrative officer (the Program Authority) under the Zoning Ordinance regulations. Please be advised that an appeal of this decision is to the Board of Zoning Appeals rather than to the Board of Supervisors. Your July 10 e -mail to the Clerk of the Board of Supervisors cannot be recognized as an appeal. To pursue this appeal, you will need to file it with the Zoning Administrator and the Board of Zoning Appeals, as outlined below. If you choose, you may also ask the Planning Commission to modify the decision under their authority in Zoning Ordinance Section 5.1 a. If you are aggrieved by this determination, you have the right to appeal it within thirty (30) days of the date notice of this determination is given, in accordance with Section 15.2 -2311 of the Code of Virginia. If you do not file a timely appeal, this determination shall be final and unappealabie. An appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning Appeals a notice of appeal which specifies the grounds for the appeal. In order for an appeal to be considered complete, it shall include a'completed application and $120 fee. The date notice of this determination was given is the same as the date of this letter.
