RE: SUB202100160 Rivanna Village Phase 2B Final Plat
Dear Andy,
We have received your comments regarding the above referenced project dated November 19, 2021 and
offer the following responses:
1. [General Comment] The final site plan for Rivanna Village Phase 2A must be approved prior to
approval of this final subdivision plat. Additional comments may be provided on the subdivision plat
based on the final layout and design of the approved site plan.
Response: Per conversation with Alan Franklin, site plan will be submitted on or around the
week of December 13 with minor remaining changes.
2. [General Comment] The final plat for Rivanna Village Phase 2A must be approved and recorded
prior to final approval of this plat.
Response: Noted. Will add DB/pg references once recorded.
3. [General Comment] There appear to be several "I" lots missing. Clarify where those lots are. Are
they proposed to eventually be located in the "residue" parcel?
Response: That is correct. Per sheet 4 of the site plan, lots I-15 thru I-24, I-27 thru I-32 and I-
39 thru I-47 are in phase 2C that will be platted later. I have updated the title block and
residue label to clarify.
4. [14-302(A)4;14-302(A)5] Ensure all the easements that were approved with the easement plat
SUB2021-00057 are identified with the appropriate deed book and page numbers on this plat.
Response: Deed book and page numbers added.
5. [14-302(A)3] Cattail Court needs to be identified as a private street, and meet private street
standards, in order to provide frontage for those parcels in Block G.
Response: Label revised and note pertaining to private streets added. (note 12)
6. [14-302(A)11] Provide the deed book and page number for the plat that created existing parcel
93A1-4R1.
Response: Title source added to sheet Vl. Will need to add db/pg of phase 2A.

7. [14-302(A)14; 14-427] The community park should be "reserved" for Albemarle County, not
"dedicated" at this time. See comments from Parks and Rec for more information.
Also, break out the acreage of the community park from the other open space areas in the table on
the cover sheet, as the community park will be publicly owned in the future, while the other open
space areas will remain privately owned.
Response: Community Park label revised. Area calculations revised to show Community Park
area separately.
8. [14-302(B)1] Provide the date of last revision of the plat on all future submittals.
Response: Revision date added.
9. [14-302(B)10] Lots cannot be located within the stream buffer. Remove the lots from the stream
buffer, or provide information where an exception was granted allowing the lots to be located within
the buffer. (Lots J34-J38 and Lot J48.)
Response: See Approved Mitigation Plan, WP0201800007.
10. [14-317] Identify who will own and be responsible for the proposed private right-of-way in
Block G, as well as the open spaces not reserved for the County (Open Spaces A-H). HOA
documents that comply with the requirements of 14-317 must be provided to County staff for
review and approval prior to the approval of this plat. These documents will then need to be
recorded along with the subdivision plat once everything has been granted final approval.
Response: Note added on sheet V1. (note 13). I have sent a request to the owner's attorney
regarding the HOA does and will forward documents once received.
Albemarle County Parks and Recreation
1. Please revise this final plat application to include an additional/separate sheet that more clearly
shows the entire proposed 18.8-acre community park that will be dedicated to public use. Because
of the number and configuration of match lines in this submission, it is difficult to determine the
location, configuration, and context of the future community park parcel.
Response: Separate sheet added for clarity (V8).
2. Albemarle County Parks & Recreation does not accept the proposed 18.8-acre community park
labeled as "hereby dedicated to public use" at this time. In accordance with ZMA201300012 Proffer
#6, ACPR / Albemarle County will accept dedication of the proffered community park for public use
following completion of park development/improvements, and following inspections and acceptance
by appropriate County staff. Therefore, please revise the labels in this final plat application to
"Future Community Park, Reserved for Future Dedication to Albemarle County for Public Use Upon
Demand" or similar.
Response: Community Park label revised.

1. Butterfield Lane is directly across from the existing Moose Ln. so this must be updated to Moose
Lane.
Response: According to the approved road plans (SUB201900156), Butterfield Lane is 175' to
the west of Moose Lane and therefore requires a new name.

Response: Notes are site plan related and not required to be included on subdivision plats.
Albemarle County Eneineerine
1. It appears possible C64 is not labeled.
Response: C64 is on sheets V5 and V6 on the corner of Terrapin Trace and Mossy Rock.
2. C35 and C37 appear twice (Lot J2, Lot J3, V3; entrance /curve, Cattail Court).
Response: C35 and C37 on lots J2 & J3 have been renumbered.
3. Cannot locate C5, C6. Please direct reviewer to these curves.
Response: C5 and C6 are on sheet V2 on the overall boundary at the cul-de-sac of Lazy Branch
Lane.
4. Please revise numerous DB XX PG XX references with reference to Easement Plat at DB 5619
PG 506, whenever appropriate.
Response: Labels have been updated with now recorded easement plat DB/pg.
5. Phase 213 of approved ROAD Plan (SUB201900156; Approved 10/8/21) must be built or bonded
prior to Phase 2B subdivision plat approval.
Response: Noted. I checked with the developer and they have indicated that they are waiting
on the bond amount from the county and will likely wait until base coat of asphalt is installed
prior to bonding any of the remaining improvements.
