I'm sorry for the frustration, but VDH review is never a quick thing. There review cycle is long to begin with and they

Also, the soil submittal paper not including everything they needed for the review has slowed it down a bit further.
Because of the dealy I had reached out to them again late last week, to see if they had an answer.
I got confirmation yesterday that they are not finished the review.

I had warned Mr. Palermo, even in the first round of comments, that the VDH review could take some time and he

I hope to hear something any day now.
So, the plat, other than VDH approval, is ready to go.
But until that happens we cannot approve, and there have been cases where the VDH did not approve — at least on the

I am sending hard copies in the mail to you and Mr. Foster.
As discussed, I have provided a markup of the plat showing the text changes that need to be made.
We have also provided two different exhibits in reference to the areas of Critical Slopes and WPO/stream buffer.
1) An exhibit that shows the County GIS layers for both the Critical Slopes and WPO/stream buffer areas.
2) An exhibit that overlays the County GIS over top of the last submission (9/21/18) of the plat. David James
(engineering reviewer) created this exhibit to help Mr. Foster understand where his plat does not agree with the County
GIS.

Mr. Foster needs to update his plat to show both the Critical Slopes and the WPO/stream buffer areas correctly.
As noted in or meeting, VDH review is still on going. I have not received anything back from them on your 9/6/18 VDH
submittal.
As noted in the comments, you do not need to resubmit the shared driveway maintenance agreement and deed of
easement. Because it is a shared driveway, and because there are no special circumstances that mandate requiring it,
the County does not need to review it. However, it is suggested that you revised the document and record it. I
apologize for any confusion I caused in the process. It had been required on previous project I reviewed, hence my
confusion.

I would say the 1' one on the pdf most closely matches the one I produced off of GIS (see attached). I ended up
choosing 5 pin/marker locations that were found by surveyor and matched them to our GIS layer. The more points
chosen the more accurate the match.

I apologize once again for the mistake I made in reference to the driveway. You were correct, although
an easement does need to be created that easement does not need to be a private street.

I have also color coded the changes in the planning comments, so that the changes will be obvious. The

be an issues.

Yes, you can email me a draft copy of the maintenance agreement and, if it is
not integrated in the maintenance agreement, you can also email me a draft of
the deed of easement for the private street.
Just in case I did not forward it to you previously, we have a template you can
choose to use for the maintenance agreement unless your lawyer wishes to
draft something more specific. I will attach the template to this email.
The template include all the items the County Attorney's office will be looking
for in the maintenance agreement. There is a checklist for all the items that
must be included in the document. I will attach that as well.
If you lawyer chooses to use a different or modified document in place of the
maintenance agreement template then they (or you) will have to fill out the
checklist, ensuring all components specified are included in the document, and
also highlight and number the portions of the document that meet the checklist
requirements.
Also, please keep in mind at this point I do not think you have made the
submission to us for the VDH that is specified in the comments (comment
#7). Please let me know if you need more information on what that entails.
Your resubmittal has not been reviewed yet, and there are a good number of
project in front of your in the review queue, but once I do the review of your
resubmission I will contact you.

Yes, you can email me a draft copy of the maintenance agreement and, if it is not integrated in
the maintenance agreement, you can also email me a draft of the deed of easement for the
private street.
Just in case I did not forward it to you previously, we have a template you can choose to use for
the maintenance agreement unless your lawyer wishes to draft something more specific. I will
attach the template to this email.
The template include all the items the County Attorney's office will be looking for in the
maintenance agreement. There is a checklist for all the items that must be included in the
document. I will attach that as well.
If you lawyer chooses to use a different or modified document in place of the maintenance
agreement template then they (or you) will have to fill out the checklist, ensuring all
components specified are included in the document, and also highlight and number the portions
of the document that meet the checklist requirements.
Also, please keep in mind at this point I do not think you have made the submission to us for
the VDH that is specified in the comments (comment #7). Please let me know if you need more
information on what that entails.
Your resubmittal has not been reviewed yet, and there are a good number of project in front of
your in the review queue, but once I do the review of your resubmission I will contact you.

However, I wanted to let you know now so that you
can move forward.
You will have to get full VDH approval on the primary
and reserve drainfields for both Tract 2 and Tract 3 and
you will need to show both the primary and reserve
drainfields on the plat.
Even with the existing field this approval is required.
What level of work and submission will be required by
VDH for the existing fields you will have to contact them
about.

As specified below, if the maintenance agreement is not from the County's template (attached) than the checklist
(attached) has to be included, filled out, and the sections of the document that include the information specified in the
checklist have to be highlighted and numbered according to the checklist.
This process avoids us having to send the document to the County Attorney's office for review extra times, which can
be time consuming.

Yes, you can email me a draft copy of the maintenance agreement and, if it is not integrated in the
maintenance agreement, you can also email me a draft of the deed of easement for the private street.
Just in case I did not forward it to you previously, we have a template you can choose to use for the
maintenance agreement unless your lawyer wishes to draft something more specific. I will attach the template
to this email.
The template include all the items the County Attorney's office will be looking for in the maintenance
agreement. There is a checklist for all the items that must be included in the document. I will attach that as
well.
If you lawyer chooses to use a different or modified document in place of the maintenance agreement
template then they (or you) will have to fill out the checklist, ensuring all components specified are included in
the document, and also highlight and number the portions of the document that meet the checklist
requirements.
Also, please keep in mind at this point I do not think you have made the submission to us for the VDH that is
specified in the comments (comment #7). Please let me know if you need more information on what that
entails.
Your resubmittal has not been reviewed yet, and there are a good number of project in front of your in the

I have chatted about your VDH approval issue with others, and it will
be one of the comments.
However, I wanted to let you know now so that you can move forward.
You will have to get full VDH approval on the primary and reserve
drainfields for both Tract 2 and Tract 3 and you will need to show both
the primary and reserve drainfields on the plat.
Even with the existing field this approval is required.
What level of work and submission will be required by VDH for the
existing fields you will have to contact them about.

I have chatted about your VDH approval issue with others, and it will be one of the comments.
However, I wanted to let you know now so that you can move forward.
You will have to get full VDH approval on the primary and reserve drainfields for both Tract 2 and Tract 3 and you will
need to show both the primary and reserve drainfields on the plat.
Even with the existing field this approval is required.
What level of work and submission will be required by VDH for the existing fields you will have to contact them about.
