COUNTY OF ALBEMARLE EXECUTIVE SUMMARY AGENDA TITLE: SUB 03-040 AVEMORE AGENDA DATE: December 17, 2003 FINAL PLAT ITEM NUMBER: SUBJECT/PROPOSAL/REQUEST: ACTION: INFORMATION: Request for authorization of a private road in CONSENT AGENDA: Yes association with a final plat(Attachment A). Waller, AICP REVIEWED BY: VWC BACKGROUND: The applicant is proposing to re-subdivide three parcels identified as Tax Map 78 -Parcel 58I; Tax Map 78B - Section 3 - Parcel 1; and, Tax Map 78B - Section 4 -Parcel 1, and is the location of the Avemore mixed-use development(Attachment B). These three parcels equal 27.156 acres in total area and are zoned R-15, Residential with proffers per ZMA 00-10. This property located is in the Rivanna Magisterial District located off of State Route 20 North and currently served from Fontana Drive and Garnett Center Drive and located in the Development Area Neighborhood 3 (Attachment C). The Comprehensive Plan recommends the site for urban density uses. The proposal is related to the phasing of Avemore into three separate lots by adjusting the existing boundary lines. Uses on the three new lots will consist of the following: Parcel A, with apartments; Parcel B,with townhomes and mixed commercial uses; and, Parcel C, with apartments. Because the proposed Parcel C does not have frontage on an existing public or private road the applicant has requested private road approval for the segment of travelway that will serve as its primary point of access. The final site plan for this development and the parking lot is currently under review and subject to administrative approval. DISCUSSION: The use of private access to two or more lots in the Development Areas requires Planning Commission review and approval. This final plat meets all requirements of the subdivision ordinance and zoning ordinance for development as shown. As stated in the applicant's request, a private road may be authorized under Section 14-232.A.3 of the Subdivision Ordinance, if that road will serve a residential subdivision developed with other than single-family detached dwelling unit. The portion of the internal travelway that is being considered for this request extends south on the from Fontana Drive along the split boulevard named Avemore Drive, and west providing access to Parcels B and C. As a result of the above mentioned site plan review and requirements set through the proffers, this section of road has been designed to the standards identified in Section 14-514: Standards for Private Roads Only. During the rezoning process the application plan for Avemore was reviewed and approved as a mixed-used and multi-density development with its own internal travelways. Therefore, staff finds the general layout of the proposed lots and their access to be acceptable. Use of this private road serves the public purpose, as it relates to Section 14-101 - Purpose of the Subdivision Ordinance, as follows: A. Improve the public health, safety, convenience and welfare of the citizens of the county by assuring the orderly division of land and its development; Use of only one private road into this site, which will ultimately serve three multi-family apartment buildings and four townhouse blocks, assures the orderly division of land by minimizing the number of entrances onto public roads. The alignment of the private road as shown on the site plan provides the most direct route to those dwelling units, avoiding open space areas, critical slopes and a stream at the rear of the parcel. The road entering this site is a two-way, split boulevard that will be built to a standard that is adequate to support the proposed apartment units within Phase I(Parcel A) and the future development of Phase II (Parcel C) and Phase III(Parcel B). 1 B. Provide residential areas with healthy surroundings for family life by assuring that land is divided and developed in a manner that is harmonious with its surrounding lands; This mixed-use,multi-density development is bordered by a mixture of apartments, single-family attached dwellings and single-family dwellings, all of which take their primary access from Fontana Drive. The approval of the private road would limit traffic from this development to a single point of access onto the existing road through a boulevard designed with traffic calming measures, such as on-street parking and a traffic circle. Additionally, when the Olympia Drive extension has been completed, this development will utilize a proffered second point of access located at its southern end. Although the most often preferred road in the County is a public road, staff notes that the private Avemore Drive will be served by a commercial entrance approved by VDOT. Furthermore,because of the interconnectedness of the uses and layout of the development, the travelways will effectively function as a single parking lot. Therefore, a privately owned and maintained road is a preferable alternative to a public road in this case. C. Implement the comprehensive plan and the policies stated in section 1.4 of the zoning ordinance through the standards and procedures established herein; This development complies with elements of the Comprehensive Plan's growth management goals because it is located in a designated Development Area where land uses, facilities and services have been planned for. Allowing development in the Development Areas helps to steer development away from the natural, scenic and historic resources often located and identified for protection in the Rural Areas. Review of this subdivision by the Site Review Committee will insure that the policies stated in Section 1.4 of the Zoning Ordinance will be implemented. D. Assure that the development of the county is consonant with efficient and economical use of public funds; and No public funds will be used for this project. E. Assure that all improvements required by this chapter will be designed, constructed and maintained so as not to become an undue burden on the community. The Engineering Department has reviewed and approved the internal circulation and the future second point of access during review of the road plans (Atachment D). All other improvements to the site have been reviewed and approved by the Site Review Committee and will be subject to inspections to ensure that they will not become an undue burden on the community. All of the travelways and supporting improvements are to be maintained by the developer and any subsequent owners of the proposed parcels. Furthermore,the developer has already proffered to contribute a share of the costs for future road improvements and installation of a traffic signal at the intersection of Fontana Drive and Route 20. RECOMMENDATION: Staff recommends approval of this private road. With allowance of the private road, staff can approve the plat administratively. The private roads are designed to carry the traffic volume expected to be generated by this development, including future development phases on Parcels B and C. The fee of the private roads will be owned by Parcel A and subject to the private access easement serving Parcels B and C,as shown on the resubdivision plat. Final site plan and drainage computation comments: 1. Comments on the plan have been addressed. However, the recorded plats must be received prior to approval, indicated in the proffers; a. Proffer E requires the connector road's right-of-way to be dedicated(recorded)prior to plan approval. Necessary drainage easements should be included. b. Proffer H requires the right-of-way or easement for a sidewalk along Rt. 20 to be dedicated (recorded)prior to plan approval. B. Final plat comments: 2. Comments on the final plat have been addressed. The bond amount for Fontana Drive improvements, Avemore Lane, and access to parcel C is$322,850. The owner will need to complete a bond request for and construction schedule to post the bond. Please contact Pam Shifflett of the Engineering office for questions regarding posting bonds. All improvements must be built or bonded prior the Engineering Department recommending approval of the plat. C. Road plan and computation comments: 3. Road plan comments have been addressed. However,the recorded plats must be received prior to approval, indicated in the proffers. a. Proffer I requires the right-of-way for widening Fontana Dnve (for a possible left turn lane addition)to be dedicated(recorded)prior to plan approval. A 12' widening in this area would appear to suffice. D. Stormwater management plan comments: (Mark Chambers, Water Resources Reviewer/Inspector) 4. All comments have been addressed. The stormwater management portion of the water protection bond is $98,000.00. E. Erosion and sediment control plan comments: (Max Greene, Erosion Control Plan Reviewer) 5. All comments have been addressed. The erosion control portion of the water protection bond is $341,000. Please contact Pam Shifflett(434-296-5861) for additional information concerning the bond. Engineering Department approval of the construction plans will be given when all comments have been satisfactorily addressed for items A-E above. A grading permit will be issued when approvals have been granted from all applicable departments and agencies, an erosion control bond has been posted, and a pre-construction conference held with the contractor, certified responsible land disturber, owner and county staff.
