OMMUNITY DEVELOPMENT
The following information shall be submitted with the application and is to be provided by the applicant:
1) Recorded plat or boundary survey of the property requested for the rezoning. If there is no recorded plat or boundary survey,please
provide legal description of the property and the Deed Book and page number or Plat Book and page number.
2) The appropriate drawings showing all existing and proposed improvements on the property,with all dimensions and distances to
property lines,and any special conditions on the property that may justify the request.
3) Fee payable.to the County of Albemarle.
4) Description of Request(include dimensions,measurements or sizes in feet):
We request a variance to the six foot setback requirement from our rear property line as specified in building permit
B200700189NNR(copy attached)to allow our proposed storage shed to be located near our rear property line.
Since this loca)ion is also within the outer limits of a 100' Resource Protection Area we have agreed to a mitigation
plan as specified by Tamara Ambler (see attached email exchange). We also have obtained the approval of our
homeowner's association for this location(see attached approval).
5) Justification shall be based on these three(3)criteria:
1. That the strict application of this ordinance would produce undue hardslup.
Since our property has a steep slope down toward the rear property line, moving the storage shed location six feet
from the rear property line would move the front of the shed up the hill such that it couldn't be leveled without the
rear being unacceptably high off the ground. Thus, we would not be able to build the shed. The very bottom of our
backyard is barely level enough to accommodate the proposed storage shed. The only other level part of our
backyard is up next to the house(and that was created via a retaining wall) and our homeowner's association won't
allow the shed to be put there, plus we wouldn't do that anyway since it would ruin that part of the house and yard.
2. That such hardship is not shared generally by other properties in the same zoning district and the same vicinity.
This hardship is not generally shared by adjacent properties. For example, our next door neighbor has a large level
area at the rear of their property.
3. That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the
district will not be changed by the granting of the variance.
The property adjacent to our rear property line is common property owned by the Forest Lakes Community
Association and is a preserved natural area. The FLCA has approved the proposed location of this storage shed (see
attached approval). Also, starting at our rear property line, there is an immediate drop off of at least fifteen feet. For
these reasons, there can be no development or other activity on the property adjacent to our rear property line. Thus,
granting this variance will be of no substantial detriment to the adjacent property and the character of the district will
not be changed.

Notes regarding Sigmon variance request:
• Since the site is within the outer limits of a 100' water resource protection zone, Tamara
Ambler has visited and inspected the site and approved a mitigation plan
• Granting the variance will have no negative impact on the adjacent property either in the
short-term or long-term:
• the adjacent property is common property owned by FLCA
• it is a preserved natural area
• there is at least a 15' drop right beyond the rear property line
• thus, no future development or other activity can take place there
• FLCA Architectural Review Board has approved the site; as well as our neighbors.
• James Grace, chair of the FLCA ARB, inspected the site and said that the ARB would be
fine with the variance if Albemarle County approves it
• Regarding the claim that there are other suitable sites for the shed:
• front and side yards are not possible
• FLCA won't allow it on the upper part of the backyard near the house
• the entire width of the lower part of the backyard has a steep slope; the slope is
less severe on the right but the 10' setback from the drainage easement pushes the
shed location to the left into the steeper part of the backyard
• Thus, the only workable location is at the bottom of the slope near the rear
property line
• Without the variance, the shed could not be built because:
• the front of the shed would face directly into the bank of a steep slope
• the front doors would not be able to swing open
• the rear would be over 2' feet off the ground (Capitol Sheds said that they do not
like to go over 2')
• A variance of 3'-4' would work if 5' is not possible.

Thanks for doing the background research on this issue and for coming out to our
house to see the actual location and environment for this proposed shed. I agree
to follow your mitigation plan by planting at least three woody plants around the
shed after it has been built. I will contact you when this is done so that you
can inspect it.

Thank you for meeting with me this morning at your property on Kendalwood
Lane. My visit was in response to your request to place a shed measuring 10
feet by 16 feet in your backyard, within a location noted on the approved
subdivision plat as being within the limits of the 100' Resource Protection
Area (RPA) . As we discussed, the RPA was established when the overall property
for the subdivision was rezoned in 1991, and the RPA extends 100 feet from
wetlands associated with Powell Creek to the east of your lot.
This RPA is characterized by a low wooded area adjacent to the stream which
then rises sharply to include approximately of your backyard area. The
backyard where the shed is proposed is within the outer limits of the RPA,
appears to be a constructed fill slope from the initial subdivision
construction, and is currently maintained as lawn. Based on my field review
today I have concluded that there will be negligible water quality impacts from
the placement of the shed in the 160 square foot area in the outer limits of
the RPA, provided that you install three (3) woody plant species as
mitigation. The species may be canopy trees, understory trees, or shrubs and
the plant species will be left up to your discretion as the landowner. Plant
lists were provided to you today for your information.
The spring planting season is roughly March 1^st through April 30Ath . This
mitigation requirement is not intended to delay the processing of your building
permit for the shed. I will follow up with you to ensure that the new plants
are installed this spring.
To finalize this mitigation plan I ask that you respond back to me in
writing/email within the next seven (7) business days that you are in agreement
with this mitigation plan and that you will implement the plan during this 2007
spring planting season. Once the planting is complete I ask that you contact
me so that I may inspect the planting and close out the file.

The fee for a variance is $120.00 and if the variance is not granted
that $120.00 is non-refundable. I seriously doubt the B.Z.A would grant

I received your phonemail message from yesterday (Friday) afternoon regarding
the building permit for the proposed shed at my house. In your message you
noted that the shed will need to be at least six feet from the rear property
line.
This will be problematic due to the slope of our lot in that area. Thus, I'm
wondering whether we can get some kind of exemption or waiver from this setback
requirement. I'm already dealing with a setback requirement from our
homeowner's association due to the storm water drainage pipe on the right side
of my property (for some reason they are

The land behind my property is a preserved natural area owned by our homeowners
association. Also, there is a dramatic elevation drop of at least fifteen feet
immediately beyond our rear property line (if you take one step beyond our rear
property line you'll fall down a steep bank) . For these reasons, if the shed

the land adjacent to our rear property line. Also, due to the angle of our
rear property line, only one corner of the shed would be within one or two feet
of the property line while the other corner would be three or four feet from

We are planning to construct a 10' x 16' storage shed in the bottom of our back yard as shown in the
attached drawing of our property. The shed will be built on site by Capitol Sheds since it would be
