Dear Ms. Eckford,
I received your letter dated July 17, 2007. Two separate appeal opportunities exist. One is contained in
the Zoning Ordinance. It sates:
34.6 DECISION OF BOARD OF ZONING APPEALS
Any person or persons jointly or severally aggrieved by any decision of the board of zoning
appeals,or any taxpayer,or any officer,department,board or bureau of the county,may present to
the circuit court of the county a petition specifying the grounds on which aggrieved within thirty
(30)days after the filing of the decision in the office of the board of zoning appeals,which petition
shall proceed in accordance with section 15.2-2314 of the Code.
The other option is not an appeal it is a rehearing. The language below is from the Board of Zoning
Appeals' rules of procedure.
Motion for Rehearing. Any decision made by the BZA may be reheard upon the granting
of a motion for rehearing approved by at least three affirmative votes. The motion may
be made only after consideration of a written application by the person requesting
rehearing, which shall be filed within thirty (30) days after the date of the BZA's original
final decision. The BZA may grant the motion if it finds that the decision has not already
been appealed to the Circuit Court and: (1) new evidence can be presented that, in the
opinion of the BZA, is relevant and material to the decision but could not have been
presented at the original hearing; or(2) in the opinion of the BZA, one or more relevant
and material conditions or situations have changed so as to bear on the BZA's original
decision. If the BZA grants the motion, it shall set the date for rehearing. Notice of the
rehearing shall be provided as otherwise required for the matter being reheard.
In your letter you state a variety of issues between you and your neighbor. My recommendation
to the Board of Zoning Appeals would be that this is not grounds for rehearing. Your alternative
variance (8 feet instead of 12) was presented to the Board by you and while they took no specific
action on that request they did consider it and denied any variance of the required setback. You
may of course make a request for a rehearing. The request will be given to the Board and if they
approve it we will set a new hearing date. For the new hearing date we will repost the property
and again send out a notice for the hearing. You may resubmit a request for a variance at any
time. We have no restriction on reapplication.
