Re: WP02021-00064 VSMP Plan, DSTavern
Dear Mr. Anderson:
Thank you for providing comments on the above project in a letter dated October 27, 2021. The
comments are repeated below with our answers in italics. Due to file sizes, all resubmitted plans and
accompanying material have been resubmitted through the website.
County Code section 17410 and Virginia Code §62.1-44.15:34 requires the VSMP authority
to act on anyVSMP permit by issuing a project approval or denial. This project is denied for
reasons listed below. The VSMP application content requirements can be found in County
Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain
(1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDLmeasures necessary.
1. SWPPP:
a. Please revise SWPPP cover to include ref. to WP02021-00064
Title has been revised to include requested reference. See sheet C-01.
b. Sec. 6.A.: PPP Exhibit: Please show initial location of:
i. Rain gauge
Rain gauge is to be located next to storage container. See sheet C-05.
ii. Portable sanitary facilities (porta-john), as required
Location of ports John has been indicated. See sheet C-05.
iii. Covered non -hazardous waste dumpster, if required
A covered waste dumpster will be required. See sheet C-05 for location.
iv. Vehicle wash waters, draining to trapping measure (Not a sediment
trap design, per se,but shallow depression —1-2 backhoe buckets.
Avoid direct drainage to tributary to Little Ivy Creek.)
Location and approximate size of wash water trap has been indicated.
See sheet C-05 as well as General Note 1, sheet C-05.

v. Concrete wash -out
Location of wash -out has been indicated, See sheet C-05. Additionally,
construction detail for concrete wash berm has been included, see sheet C-06 B.
vi. On -site fuel, if required
Contractor has indicated no on site fuel is required. See General Note 3, sheet
C-05.
vii. Paint, stucco, chemical storage
Storage container location has been indicated. See sheet C-05.
c. Sec. 8: Although county personnel will inspect, Applicant is required to
retain qualified (contractor/third-party) E&S inspection personnel to
perform ESC inspections and evaluatecompliance relative to VESCH, 3`d
Edition, 1992.

B. Pollution Prevention Plan (PPP) —see SWPPP item b., above
The PPP content requirements can be found in County Code section 17-404.
Understood.
C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or
disapprove a SWMP. Thisplan is disapproved for reasons listed below. The stormwater
management plan content requirements can befound in County Code section 17-403.
1. Please combine individual sheets submitted into a single plan set (single file /.PDP).
Understood. Sheets for submission set have been combined.
2. Revise plan set title to include ref. to WPO202100064.
Title has been revised to include requested reference. See sheetC-01.
3. C-01 Note that 'Jon Garber is the certified land disturber until a general contractor is
hired by the owner atwhich time liability for land disturbance shifts to the general
contractor; does not effect transfer of environmental responsibility to the GC. Please
see Sec. 30 of SWPPP template, Delegation of Authority, which effects transfer. Note:
Sec. 10 of SWPPP is complete with Delegation of Authority from Janet Artz to Jeff
Testerman. It appears C-01 Note may be obsolete, or require update.
Understood. Note has been revised to indicated Jeff Testerman as the certified land
disturber. See sheet C-01,
4. C-04: Include note explaining whether demo material is to be sent to a landfill, or
whether an alternativewaste site is proposed. Note: SWPPP must reflect off -site
export, unless material is sent to landfill.
Demo material is intended to be sent to a landfill. Requested note has been included.
See General Note 9, sheet C-03 and General Note 14, sheet C-04.

5. C-05B
a. Include statement affirming all post -developed flow is sheet flow that
meets requirements at9VAC25-870-66.D., if this is the case.
All post -development flow is sheet flow. Requested statement has been
added. See General Note 1, sheet C-05 B.
b. VRRM Site Tab indicates TP Load Reduction Required (lb/yr)=0.141b. Please
copy statement from C-05A that 'Water quality requirements indicate a 0.14
pounds phosphorus offset is required.Owner intends to purchase this on the
third -party market' Note, plan may not be approved without letter of nutrient
credit availability from Ivy Creek bank, the only bank eligible to provide credits,

Project site, circled: Since first (NPS data viewer) stream encountered (downstream)
is impaired, DEQrestricts eligible banks to a single bank —Ivy Creek bank: this bank
appears to have sufficient availablephosphorus credits to support this project. See
contact information below.

6. General:
a. Note: Nutrient credit purchase (0.141b.) is not required for VSMP /WPO
plan approval, but isrequired prior to receiving a Grading Permit.

b. An Approved WPO plan is required prior to site plan approval.

c. A state permit (VAR10) is not required for this project (LOD =0.57 Ac.).

D. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove
an ESCP. This planis disapproved for reasons listed, below. The erosion control plan
content requirements can be found in County Code section 17-402.

00 Note: County ESC Inspector assigned to project may consider whether to allow
Trackout® control mat in lieu of a typ. stone construction entrance, in lieu of a paved
construction entrance with wash rack. Inspectors evaluate on a case -by -case basis, and
consider compliance performance, but request ACDSM p.8 detail be placed on the plan
for reference, in case it is needed.

Process:
After approval, plans will have to be bonded. The bonding process is begun by submitting a
bond estimate request form and fee to the Department of Community Development. One of
the plan reviewers will prepare estimates and check parcel and easement information based
on the approved plans. The County's Management Analyst will prepare bond agreement forms,
which will have to be completed by the owner and submitted along with cash, certificates or
sureties for the amounts specified. The agreements will have to be approved and signed by the
CountyAttorney and County Engineer. This may take 2-4 weeks to obtain all the correct
signatures and forms.

This plan proposes 0.14 lb. nutrient credit purchase. Although nutrient credit purchase is not
required for WPO planapproval, it is required prior to pre -construction, to receive a Grading Permit.

conference. Applicants must complete the request for a pre -construction conference form,
and pay the remainder of the application fee. The form identifies the contractor and
responsible land disturber, and the fee remaining to be paid.This will be checked by county
staff, and upon approval, a pre -construction conference will be scheduled with theCounty
inspector. At the pre -construction conference, should everything proceed satisfactorily, a
joint VSMP and grading permit will be issued by the County so that work may begin.
