RE: SUB200500302 Redbud Subdivision — Phase II
Dear Mr. Smith:
The Planning Commission at its meeting on August 19, 2008 for the following reasons denied the
development proposal referenced above:
The Planning Commission by a vote of 6:1 denied the request for SUB - 2005 - 00302, Redbud Subdivision,
Phase II to modify the preliminary plat approval to allow Redbud Lane to be a private street. The Commission
found that the applicant failed to satisfy Section 14- 232(A)(3). In order to obtain approval of a private street
under Section 14- 232(A)(3), the applicant must demonstrate that the general welfare, as opposed to the
proprietary interest of the applicant, would be better served by the construction of Redbud Lane as a private
street than by its construction as a public street.
This decision may be appealed to the Board of Supervisors by filing a written request with the Director of
Community Development along with a fee of $240 within ten calendar days of the decision. (Subdivision
