Dear Ms. McGetrick:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
We have examined our records with respect to that certain real property lying in the County of
Albemarle, Virginia ("County"), with no currently assigned address, but with frontage on
Berkmar Drive and Woodburn Road, and being designated in the County's real estate tax
assessment records as Tax Parcel Identification No. 45-68C2 & 45-68EO (the "Property"). We
are pleased to advise you that:
The Property is currently zoned R-15 Residential (R-15) under Chapter 18 of the Albemarle
County Code ("Zoning Ordinance"). The permitted uses of the Property are provided in
Section 18 of the Zoning Ordinance. They include residential uses with a density of up to 15
dwelling units per acre with a possible 30% bonus density increase for affordable housing,
without the necessity of obtaining a conditional or special use permit, variance, special
exception, or other authorization or approval. The Property is subject to the Steep Slopes
and Airport Impact Overlay Districts as described in Section 30 of the Zoning Ordinance.
The Property and the improvements on the Property are currently in compliance with all
applicable requirements of the Zoning Ordinance. A review of our files found (i) that the
current use of the Property is vacant land, and (ii) vacant land is not a use that is listed in
the Zoning Ordinance. This does not constitute any violation and is permitted to remain
vacant.
To the best of my knowledge, the Property is currently in compliance with all applicable
requirements of the Zoning Ordinance. A review of our files found (i) no violations or alleged
violations or regulations applicable to the Property, whether pending, contemplated, or
having already occurred and (ii) no fees due or pending with respect to any matter before
the County Zoning Office; and (iii) no pending application for rezoning of the Property.
Further, no proceeding to challenge the zoning or other governmental approval or use of the
Property is pending or overtly threatened to the best of our knowledge.
• The Property is subject to SDP2021-00044 an Initial Site Plan, approved 06/28/2021. Final
Site Plan approval is required before any building permits may be issued for proposed
development.

• The Property is recognized as two separate parcels of land under the subdivision ordinance
of the County. It may be conveyed, leased, or mortgaged as a separate parcel and currently
complies with such subdivision ordinance and other applicable subdivision
laws. The Property is not subject to conditions or special limitations imposed by the County
in connection with any subdivision approval of the Property.
