County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to act on any
VSMP permit by issuing a project approval or denial. This project is approved.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain
(1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. SWPPP:
a. Please revise SWPPP cover to include ref. to WP02021-00064. (Rev. 1) Not addressed
/Withdrawn. Eventual approval stamp will identify WPO2021-00064.
b. Sec. 6.A.: PPP Exhibit: Please show initial location of. (Rev. 1) Addressed.
i. Rain gauge
ii. Portable sanitary facilities (porta-john), as required
iii. Covered non -hazardous waste dumpster, if required
iv. Vehicle wash waters, draining to trapping measure (Not a sediment trap design, per se,
but shallow depression — 1-2 backhoe buckets. Avoid direct drainage to tributary to
Little Ivy Creek.)
v. Concrete wash -out
vi. On -site fuel, if required
vii. Paint, stucco, chemical storage
c. Sec. 8: Although county personnel will inspect, Applicant is required to retain qualified
(contractor/third-party) E&S inspection personnel to perform ESC inspections and evaluate
compliance relative to VESCH, Yd Edition, 1992. (Rev. 1) Persists. As ollow-up: WPO plan may
be approved without name, telephone number, and qualifications of personnel conducting
inspections, but a qualified individual must be listed prior to receiving a Grading Permit. (Jeff
Testerman appears qualified, iftertified Land Disturber /RLD.)
B. Pollution Prevention Plan (PPP) —see SWPPP item b. above. (Rev. 1) Addressed.
The PPP content requirements can be found in County Code section 17-404.

VSAP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWAP. This
plan is approved.
1. Please combine individual sheets submitted into a single plan set (single file /.PDF). (Rev. 1) Addressed.
2. Revise plan set title to include ref. to WPO202100064. (Rev. 1) Addressed.
3. C01 Note that `Jon Garber is the certified land disturber until a general contractor is hired by the owner at
which time liability for land disturbance shifts to the general contractor,' does not effect transfer of
environmental responsibility to the GC. Please see Sec. 10 of SWPPP template, Delegation of Authority,
which effects transfer. Note: Sec. 10 of SWPPP is complete with Delegation of Authority from Janet Artz
to Jeff Testerman. It appears C-01 Note may be obsolete, or require update. (Rev. 1) Addressed.
4. C04: Include note explaining whether demo material is to be sent to a landfill, or whether an alternative
waste site is proposed. Note: SWPPP must reflect off -site export, unless material is sent to landfill. (Rev. 1)

5. C-05B
a. Include statement affirming all post -developed flow is sheet flow that meets requirements at
9VAC25-870-66.D., if this is the case. (Rev. 1) Addressed.
b. VRRM Site Tab indicates TP Load Reduction Required (lb/yr)=0.141b. Please copy statement
from C-05A that `Water quality requirements indicate a 0.14 pounds phosphorus offset is required.
Owner intends to purchase this on the third -party market.' Note, plan may not be approved
without letter of nutrient credit availability from Ivy Creek bank, the only bank eligible to provide

Project site, circled: Since first (NPS data viewer) stream encountered (downstream) is impaired, DEQ
restricts eligible banks to a single bank Avy Creek bank; this bank appears to have sufficient available
phosphorus credits to support this project. See contact information below.

Process:
After approval, plans will have to be bonded. The bonding process is begun by submitting a bond estimate request
foam and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and
check parcel and easement information based on the approved plans. The County's Management Analyst will
prepare bond agreement foams, which will have to be completed by the owner and submitted along with cash,
certificates or sureties for the amounts specified. The agreements will have to be approved and signed by the County
Attorney and County Engineer. This may take 24 weeks to obtain all the correct signatures and forms.
This plan proposes 0.14 lb. nutrient credit purchase. Although nutrient credit purchase is not required for WPO plan
approval, it is required prior to pre -construction, to receive a Grading Permit.

After DEQ ea eFage is issued, via the ,.aveFage letw, the County can hold a pre -construction conference.
Applicants must complete the request for a pre -construction conference form, and pay the remainder of the
application fee. The form identifies the contractor and responsible land disturber, and the fee remaining to be paid.
This will be checked by county staff, and upon approval, a pre -construction conference will be scheduled with the
County inspector. At the pre -construction conference, should everything proceed satisfactorily, a joint VSMP and
grading permit will be issued by the County so that work may begin.
