Hello Supervisors Gallaway and McKeel - - -
I hope you've each had a very nice holiday season so far, and I hope you'll enjoy celebrating the end of 2019 and
the beginning of 2020.
I'm writing to request your thoughts and guidance on an upcoming community meeting that is required of the
application ZMA201900014 "Commercial Development." CDD staff are looking for your direction prior to
coordinating further with the applicants and the CAC Chair(s).
Please follow up with Rachel, Michaela, and I when you are able, after you've reviewed the following info (below).
I've provided an overview of the issue, our question, and pertinent project information.
And please also note that I will likely not be the lead reviewer on this ZMA application for much longer, as I will be
transitioning out of my Senior Planner role with Community Development and into the new Chief of Parks Planning
role with Parks & Recreation at the end of January.

issue and our question (below).
• Issue:
• The subject property's location requires a decision to be made about which CAC should host the community
meeting: Places29-Hydraulic or Places29-Rio.
o The subject property for this ZMA application (TMP #61-134A) is technically located within the area
covered by the Places29 — Hydraulic CAC.
o However, this property is also located within the Rio/29 Small Area Plan area.
o Additionally, the subject property is within the Rio Magisterial District.
• Question:
• Should the required community meeting for this ZMA application be conducted at the Places29— Hydraulic
CAC meeting, or at the Places29— Rio CAC meeting?
o Note: Neighborhood Planning staff recommend that members of both CACs be informed about this
community meeting, regardless of which CAC hosts the community meeting, so that all interested
CAC members have the opportunity to attend.
• Additional Info— Proposal:
• This application type is a ZMA, but this is not a request for the County to rezone the subject property or
otherwise amend the zoning map. The existing zoning is PDMC, and the proposed zoning is PDMC.
• Instead, this ZMA application requests approval of a ZMA Application Plan for the subject property's portion of
an existing Planned Development— Mixed Commercial (PDMC) zoning district.
• This step (ZMA application review/approval) is a requirement of Zoning Ordinance Section 8 ("Planned
Development Districts— Generally"), Subsection 8.5.5.5 ("Site plan and subdivision plat requirements when
there is no application plan."). That Code section essentially states that BOS approval of a ZMA Application
Plan is required prior to staff review or approval of a Site Plan in this particular type of circumstance (where the
PDMC zoning district was previously established by the BOS without an Application Plan that shows the
conceptual development of this subject property's portion of the overall Planned Development zoning district).
o You may recall a very similar recent application for a portion of the PDSC zoning district on
Pantops, which required BOS approval of ZMA201800005 prior to the submission of a site plan for
the "Hampton Inn" project on State Farm Blvd.

• Additional Info— Subject Property (TMP#61-134A):
• The subject property is TMP#61-134A— an undeveloped, forested 0.9-acre parcel with frontage on Route 29
just south of the southern entrance to Fashion Square Mall.
