Bill Fritz, John Shepherd and I have reviewed the plat and talked about the issues at hand. We agree that the main issue with this proposal is whether the barn meets the definition of an accessory structure and whether the proposed subdivision could be permitted with the barn structure located where it is. After discussing with John (on behalf of the Zoning Administrator), it has been determined that the barn does not meet the definition of an accessory structure to a primary use, building, or structure on the proposed parcel. Therefore, the barn is a primary structure that must meet the setbacks set forth in section 10.4. The plat cannot be approved because it would create a structure that violates the setbacks. Please advise us as to whether you wish to make revisions to your submittal or you want us to take formal action to deny this application.
