HomeMy WebLinkAboutSDP200800130 Legacy Document 2008-10-10U ®u�u ��RGLC}1P County of Albemarle Department of Community Development Memorandum To: Gerald Gatobu, Senior Planner From: Amelia McCulley, Zoning Administrator Division: Zoning & Current Development Date: October 8, 2008 Subject: Parking Determination — LTACH, Northridge, Sieg Warehouse and Moser Radiation Therapy Center (TM 59, Parcels 23B, 23131 and 23C for SDP 2008 -130 and SDP 2008 -065) I have reviewed the revised parking study (original dated January 2008 revised August 2008) submitted by Kimley -Horn and Associates, Inc. for the University of Virginia for these projects. At this time, I am giving approval to the parking projections and proposal. This approval is also based on the cumulative parking requirement information in the matrix dated 9/26/08 and attached to this memo. This parking study is approved as evidence of adequate parking in accord with Section 4.12.7 of the Zoning Ordinance. In accordance with my conditional approval for the preliminary site plan, the applicant conducted further parking surveys. Based on these surveys and a more comprehensive parking analysis, the applicant revised the parking study. This determination also considers information provided by the applicant in letters dated August 26th from Kimley -Horn and Associates, dated September 8th from UVA and dated September 9th from the Timmons Group. There are several general factors I have considered in rendering this decision. These include: 1. There is a single and organized entity (University of Virginia) that exerts unified control over these several properties. This allows changes to be made in the event parking problems are experienced. These changes within the applicant's control include and are not limited to: redistributing types of parking between properties (such as employee, delivery, patient, etc.) as well as making more significant changes such as requiring employees to park offsite and take a shuttle bus to this location. 2. The consultant's assumptions utilize a 90% parking occupancy goal. This is practical in that it allows for open spaces. It is also provides a 10% margin of error. In addition to these general factors, there are several considerations that are specific to these uses: A. The Moser Radiation Center is a unique use that does not fit into the standard parking requirements within Section 4.12. The patient visits last for about an hour and a half, significantly longer than the patient visits in a more standard medical office. The number of patients per square foot as compared to a standard medical office is also significantly less. Therefore, the parking approval for this use does not constitute a "parking waiver" approval. This is an approval under Section 4.12.7 for an unscheduled use. B. The majority of the future uses currently exist. (Obviously, the LTACH and the radiation center do not.) This allows the actual data from parking surveys to carry great weight, even more so than standards found within manuals. LTACH Parking Determination October 8, 2008 Page 2 C. I concur that the parking generation based on Gross Floor Area should not carry great weight and results in an artificially high parking demand number /figure. Parking generation based on number of beds and number of employees at the proposed LTACH facility was also evaluated. Because this parking plan involves sharing parking between more than one parcel and owner, review under Section 4.12.8 is applicable. The applicant's attorney should consult with the County Attorney's office to determine if recordation of an instrument is necessary (see below). e. Instrument assuring continuation of off -site parking. If stand -alone parking or off -site shared parking is to be provided, the applicant shall submit with the application for a site plan, site plan waiver or, if a site plan is not required, with an application for a zoning compliance clearance, an instrument that restricts the use of that part of the land on which parking is provided to that use, and assures that a minimum number of parking spaces as required by this section shall be established and maintained for the life of the use. The instrument shall be in a form that is suitable for recording, shall be subject to review and approval as to form and substance by the county attorney, and shall be recorded in the office of the clerk of the circuit court of the county before the site plan or site plan waiver is approved. As the parking requirements for the use or structure change, subsequent instruments may be submitted, reviewed, approved and recorded that rescind or modify the prior instrument. By copy of this memo, I am also approving the overhang of several parking spaces from one parcel into an adjoining parcel. This requirement from Section 4.12.16 b is granted under the authority of Section 4.12.2.2(c(2)). My approval for the site plan is based on this parking study. As noted in the preliminary approval, the final site plan shall detail the following: a. Existing and proposed parking b. Parking requirements and provisions for each of the uses on all of these properties c. The cumulative requirements and d. Any provisions to enforce /implement the restrictions for employee parking, such as signage and the like. Item c and d may be accomplished by using the matrix dated 9126108 as a detail on the site plan. If you have any questions, please do not hesitate to ask.
