January 11, 2022 County of Albemarle I Community Development Department Planning Services RE: COMMENT RESPONSE to 2st Review, SUB202100169, Iw Proper Easement / BLA Plat TO: Ms. Mariah Gleason C: Mr. David James Mr. Reid Murphy Please find below our responses to review of the plat referenced above (Ivy Proper Easement / BLA Plat); we appreciate your comments and review. Included (below) are comments provided by Albemarle County with responses (in red), accordingly: 1. [14-303(A)] statement of consent to division. In the statement of consent to division, it looks like the language describing the land does not capture all the parts of the plat title. Please review and revise accordingly. Rev. I: Comment addressed. 2. [14-303(D)] Acreage. In Area Tabulation section, it appears that what is shown as a minus sign should be a plus sign. This may just bean error caused by the resolution of the document. If so, please revise the document such thatthe plussign isvisible. Rev. I: Comment addressed. 3. [14-303(0-P)] signature and Notary panels. The plat proposes easements on the neighboring property, TMP 58A2- 20A. In which case, the owner of TMP 58A2-20A (5 Guys without Fries Too LLC) will need to sign this plat as well. Please revise the plat to include a signature and notary panel for the aforementioned property owner. Rev. I: Comment addressed. 4. [Comment] In Note 1 'Property & Zoning Information", it looks like there might be a clerical error in the information for TM 58A2-20. Staff believe "Zonee" was meant to be "Area". Rev. I: Comment addressed. 5. [Comment] Consider expanding the private access easement (for TMP 58A2-20A) to include parking spaces if they are planned to be shared between properties. Rev. 1: Comment addressed. 6. [Comment] Reminder that revised plats must include the original date of drawing and the revision date(s)ofeach subsequentversion of the plat. Rev. 2: Comment still valid. Addressed. Original (Oct. 1), 2o1 submittal (Dec. 8), and 3r1 submittal (Jan. 12,'22) dates are shown. [14-302(A)(15)] With the addition of an off -site easement, please add the name and address for the owner(s) of record for TMP 58A2-20A, 5 Guys Without Fries Too LLC. Rev. 2: Comment addressed. 8. [Comment] Generally, the County will be looking for consistency between all plans associated with this development, even though individual approvals are sequenced. Please ensure that all of the initial plans/plats are coordinated and comprehensive of the aspects required to allow the expedient approval of the final site plan. Rev. 2: Comment still valid. Prior discussions regarding a storm drainage easement crossing the RR corridor on the site plan are confirmed by Engineering as corrected (on site plan). Also, SWM Forest and Open Space Easement is now shown on the plat. OTHER SRC REVIEWERS Albemarle County Engineering Services (Engineer) David James, diames2(olalbemarle.org—Requests changes 1. The WPO plan will need to be approved prior to plat approval. Noted. 5. Note: Engineering will draft SWM deed of dedication once all plat comments are addressed. This will be sent to the owner. Noted. 6.The WPO plans call for an easement to protect forest/open space. Please show this "SWM FORESTAND OPEN SPACE EASEMENT' with this plat. SWM Forest and Open Space Easement is now depicted.
