SUPPLEMENTAL DECLARATION TO DECLARATION OF
PROTECTIVE COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS
THIS SUPPLEMENTAL DECLARATION TO DECLARATION OF
PROTECTIVE COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS (the
"Supplemental Declaration") is made this day of 1 2021, by
STANLEY MARTIN HOMES, LLC, a Delaware limited liability company, previously named
Stanley Martin Companies, LLC, domesticated as a Virginia limited liability company, successor
by merger to SM Charlottesville, LLC, a Virginia limited liability company ("Declarant").
WITNESSETH:
WHEREAS, on January 8, 2020, Declarant recorded that certain Declaration of Protective
Covenants, Conditions, Restrictions and Easements dated January 2, 2020, in the Clerk's Office of
the Circuit Court of the County of Albemarle, Virginia (the "Clerk's Office"), in Deed Book 5264,
page 306 (the "Declaration").
WHEREAS, capitalized terms used herein shall have the meaning set forth in the
Declaration unless otherwise defined herein.
WHEREAS, the Declaration governs the planned community located in the County known
as Pleasant Green and, pursuant to Section 6.01 thereof (the "Annexation Provision"), Declarant
reserved the unilateral right and privilege to expand the Property during the Development Period
by submitting additional property to the provisions of the Declaration and the jurisdiction of the
Association without the consent of any Member by recording a Supplemental Declaration in the
Clerk's Office.
WHEREAS, Declarant, pursuant to the Annexation Provision, wishes to supplement the
Declaration to include that certain real property owned by Declarant and more particularly
described on Exhibit A attached hereto and incorporated herein by this reference (the "Additional
Property") under all of the provisions of the Declaration and to subject the same to the jurisdiction
of the Association.
NOW THEREFORE, pursuant to the provisions of the Annexation Provision, Declarant
declares that the Declaration is hereby supplemented as set forth below.
The Property is hereby expanded such that all of the Additional Property is hereby
subjected to the provisions of the Declaration and the jurisdiction of the Association,
and the provisions of the Declaration shall apply to all of the Additional Property as if
the same were originally part of the Property.
2. This Supplemental Declaration shall be effective upon recording in the Clerk's Office.
