We offer the following responses to the memorandum: 1. [14-302(A)(16), 14-307.1] Dam break inundation zone. Pursuant to Virginia Code § 10.1-606 3, DCR has determined that Phase 2 will change the spillway design flood standards of the impounding structure. The County cannot approve this application until the requirements of Virginia Code § 15.2-2243 1 are met as outlined in the letter dated February 10, 2021. a. Engineering study. If the Virginia Department of Conservation and Recreation determines that a plan of development proposed by a subdivider would change the spillway design flood standards of an impounding structure pursuant to Virginia Code § 10.1-606.3, the subdivider shall submit an engineering study in conformance with the Virginia Soil and Water Conservation Board's standards under the Virginia Dam Safety Act in Virginia Code § 10.1-604 et seq. and the Virginia Impounding Structure regulations in 4 VAC 50-20. The engineering study shall be reviewed and acted upon by the Virginia Department of Conservation and Recreation as provided in Virginia Code § 15.2- 2243.1. b. Mapping information. The subdivider shall provide the dam owner, the county, and any other affected localities with information necessary for the dam owner to update the dam break inundation zone map to reflect any new development within the dam break inundation zone following completion of the development. Response: DBIZ issue has been resolved. 2. [14-302(B)] Provide density information for this phase including the number of lots proposed and the density calculation. Also, indicate the types of units for the lots, it appears that Lots 65-74 are now single family detached rather than attached, which was shown on the initial site plan and preliminary plat. Response: Density information added. 3. [14-303(F)] Provide a phasing plan. This is a final plat for a larger phase and a phasing plan should be provided to track the density and types of units. A PROFESSIONAL CORPORATION Serving Virginia Since i956 4. [14-302(B)(8)] The side setback per 4.19 is 10 feet unless the units are attached. See above comment regarding the types of units. Response: According to the code the side setback is only 10' on infill lots. These would be non- infill so we have added 5' setbacks per the code section. 5. [14-302(A)(5)] Public easements. The deed book and page number for the Greenway easement will be needed prior to approval of the plat. Response: DB/pg added. 6. [14-302(A)(5)] The right of way shown on this plat needs to match the BLA/Easement plat (SUB2021-004) under review. Also, the BLA/Easement plat will need to be approved and the deed book and page number will need to be added to this plat prior to approval. Response: SUB202100004 has been approved and we are waiting on recordation. We will add DB/pg as soon as it is recorded. 7. [14-317] Instrument evidencing maintenance of certain improvements. Instruments are needed for the proposed improvements prior to final approval (open space, private drainage, retaining walls etc). Response: Supplemental declaration attached. 8. [SP1990-103 Condition #2] Condition #2 of the special use permit that was approved in 1990 requires the crossing to be made prior to development. Zoning staff is reviewing this condition in relation to this submittal to determine if the crossing will need to be built. I will pass on any information from zoning once an interpretation of the condition is made. Response: Per letter of determination dated 11-3-2021, these lots are not included in the area subject to SP1990-103. Letter of determination attached. VDOT Comments 1) Plat does not appear to match the road plans with the last revision date of February 15, 2021. Storm water drainage system and building lots have changed. Response: Plat has been updated to match latest road plans submitted on November 5, 2021. 2) Plat does not appear to match the site plan with the last revision date of February 24, 2021. Sanitary sewer alignment appears different. Response: Plat has been updated to match latest road plans submitted on November 5, 2021. 3) Approved road plans meeting SSAR, and in compliance with the VDOT Road Design Manual are required prior to plat approval. Response: Noted. Albemarle County Building Inspections Add the following note to the general notes page: (notes not listed here for simplicity) Response: Notes are site plan related and not required to be included on subdivision plats. E911 1. Alston St must end at the round -a -bout. The "Alston St" that continues should be labeled Rambling Brook Ln. Response: Road name has been updated. 999 Second Street SE. Charlottesville. A public storm drain easement appears to be missing in front of lots 65-68. Ensure all easements are shown. Response: Plat has been updated to match latest site plan submitted on January 7, 2022. 2. Please label the easements with the same name as shown on the WPO, road and site plans. One example is the variable width public SWM facility easement on this plat vs. the WPO SWM facility and maintenance easement. Response: Labels updated per latest plan. 3. There are more SWM facility easements and a forest & open space easement proposed with WP0202000053. Also, retaining wall easements that cross lot lines. Will those be on a different plat? If not, please show them on this plat. Response: All FOS easements and retaining wall easements are being created on the phase 213 plat (SUB202100166). 4. The SWM and public drainage easements will need associated deeds. Response: Awaiting deeds from County. Thank you for taking the time to review this plat.
