SIGNS

A sign permit must be issued in accordance with the Albemarle County Sign Regulations prior to
placement of any signs on -site. Contractor shall provide handicap signs as shown on plan.
LANDSCAPE
All areas outside of buildings and pavement within the parcel will be maintained as grass and will be
landscaped. The total landscaped area is 44.7% of the site. Street Trees and Preserved Canopy are as shown.
LIGHTING
All outdoor light fixtures shall not exceed 3000 lumens. No other luminaires are proposed.
GENERAL NOTES
1. The information and data shown or indicated with respect to the existing underground utilities at or contiguous to the site are
based on information and data furnished to the owner and engineer by the owners of such underground facilities or others.
The owner or engineer shall not be responsible for the accuracy or completeness of such information or data. The contractor
shall have full responsibility for confirming the accuracy of the data, for locating all underground utilities, for coordination of the
work with owners of such underground utilities during construction, for the safety and protection thereof and repairing any
damage thereto resulting from the work. All of these conditions shall be met at no additional cost to the owner. The contractor
shall contact "Miss Utilities" of Virginia at 1-800-552-7001 prior to the start of work.
2. When working adjacent to existing structures, poles, etc., the contractor shall use whatever methods that are necessary to
protect structures from damage. Replacement of damaged structures shall be at the contractor's expense.
3. The contractor shall be responsible for protecting all existing site structures from damage and coordinating work so that the
owner can make necessary arrangements to modify/protect existing structures from damages.
4. The contractor shall be responsible for notifying all utility owners, adjacent land owners whose property may be impacted and
the Virginia Department of Transportation prior to completing any off -site work.
5. Contractor shall notify and coordinate all work involving existing utilities with utility owners, at least 72 hours prior to the start
of construction.
6. Contractor shall immediately report any discrepancies between existing conditions and contract documents to the owner and
engineer.
7. Contractor shall submit for the approval of the owner submittals of all specified materials listed in the plans, to include shop
drawings, manufacturer's specifications and laboratory reports. the owner's approval of submittals will be general and will not
relieve the the contractor from the responsibility of adherence to the contract and for any error that may exist.
8. All bare areas shall be scarified, limed, fertilized, seeded and mulched.
9. All trees, saplings, brush, etc. shall be removed from within the right of way and the drainage easements.
10. Visibility of all mechanical equipment from the Entrance Corridor shall be eliminated.
11. Retaining walls require separate building permits.
12. All water service lines, sanitary laterals, and sprinkler lines must be visually inspected by the Albemarle County Building
Department from the main to the structure.
13. Buildings or or structures built before January 1, 1985 must have an asbestos survey performed in order to apply for a
demolition permit. Asbestos removal permits are required if positive for such from Albemarle County and VDOLI. Contact
VDOLI for their additional requirements and permits for demolition projects at 540-562-3580 x131.
14. Where the flood level rims of plumbing fixtures are below the elevation of the manhole cover of the next upstream manhole in
the public sewer, the fixtures shall be protected by a backwater valve installed in the building drain, branch of the building
drain or horizontal branch serving such fixtures. Plumbing fixtures having flood level rims above the elevation of the manhole
cover of the next upstream manhole in the public sewer shall not discharge through a backwater valve.
15. Pursuant to Proffer #2 of the approved ZMA, a left turn lane may be warranted with any future buildout of the subject property.

GENERAL CONSTRUCTION
NOTES FOR PUBLIC ROADS
1. Prior to any construction within any existing public right-of-way, including connection to any existing road, a permit shall be obtained from the Virginia Department of Transportatio
(VDOT). This plan as drawn may not accurately reflect the requirements of the permit. Where any discrepancies occur the requirements of the permit shall govern.
2. Construction inspection of all proposed roads within the development will be made by the County. The contractor must notify the Department of Engineering (296-5861) 48 hours in
advance of the start of construction.
3. All materials and construction methods shall conform to current specifications and standards of VDOT. All excavation for underground pipe installation must comply with OSHA
Standards for the Construction Industry29 CFR Part 1926

4. Erosion and siltation control measures shall be provided in accordance with the approved erosion control Ian and must be installed prior to an clearing, radio or other

construction.
5. Upon completion of fine grading and preparation of the roadbed subgrade, the contractor shall have CBR tests performed on the subgrade soil. Three (3) copies of the test results
shall be submitted to the County. If a subgrade soil CBR of 10 or greater is not obtainable, a revised pavement design shall be made by the design engineer and submitted with
the test results for approval.
6. All slopes and disturbed areas are to be fertilized seeded and mulched. The maximum allowable sloe is 2:1 horizontal vertical . Where reasonably obtainable lesser slopes of 4:1 or

7. Surface drainage and e discharge must be retained within the public right-of-wayor within easements prior to acceptance b VDOT. All drainage outfall easements are to be

four (4) feet offset from the edge of pavement to the face of guardrail, and roadway shoulder widths shall be increased to seven (7) feet.
9. Where urban cross sections are installed, all residential driveway entrances shall conform to VDOT CG-9(A,B or C).

15. Road plan approval is subject to final subdivision plat validation. Should the final plat for this project expire prior to signing and recordation, then approval of these plans shall be
null and void.
16. Traffic control or other regulatory signs or barricades shall be installed by the developer when, in the opinion of the Director of Engineering, or the Director's designee, they are
deemed necessary in order to provide safe and convenient access.
17. Use VDOT standard CD-1 or CD-2 underdrains under the subbase material at all cut and fill transitions and grade sag points.
18. A video camera inspection is required for all storm sewers and culverts that are deemed inaccessible to VDOT inspections and are to be accepted into VDOT's maintenance program
and ownership. The video inspection shall be conducted in accordance with VDOT's video camera inspection procedure and with a VDOT and/or County inspector present. In addition,
if high -density polyethylene (HDPE) pipe or pipe system is installed, the contractor and a representative from the pipe manufacturer should hold a preconstruction meeting for
installation training. The pipe manufacturer should spend a minimum of two hours on the job site during the initial pipe installation.

As -built drawings shall be prepared for all public and private roadway construction projects within Albemarle
County. The following is a list of the minimum information required on the drawings. Additional information
may be requested The County only reviews private road as -built plans. The county does not review or
approve public road as-builts. For questions regarding public roads. please consult with VDOT.
1. A signed and dated professional seal of the preparing en_aneer or survewr-
2. The name and address of the firm and individual preparing the drawings on the title sheet
3. "As -built' nnist be labeled on the drawings with the date of preparation or revision
4. The constructed location of all items associated with the road construction must be shown The items
include. but are not limited to the following:
a. Horizontal Alignment - Show and label measurement points. and an interpreted line between
measurements- Show the as -built centerline over the design centerline. Distinguish between the design
elevation and as -built by labels and line type. Measurements shall be at each station as a miminiu m. and
at frequent enough intervals to accurately portray the as -built centerline. and the position of the roadway
within the right-of-way or easement. Any portions outside the right-of-way or easement must be
corrected by plat of constriction
b. Vertical Alignment - Show and label measurement points. and an interpreted line between
measurements. Show the as -built centerline over the design centerline. Distinguish between them by
labels and line type. Write the constructed vertical elevations adjacent to the design elevations.
Distinguish between the elevations by striking a single line through the design elevation- Measurements
shall be at each station as a imm maim and frequent enough intervals to accurately portray the as -built
centerline. For alignments which deviate significantly from the design, provide curvature and sight -
distances. Corrections may be regtured for alterations from the design alignment.
b- Edge of Pavement - Display the constnccted edges of pavement and width measurements at every
station or more frequently if necessary to accurately portray the as -built edges. Show the as -built edges
over the design edges. Show and label constructed edge of pavement radii for all intersections and cul-
de-sacs. Edges for sidewalk as well as ramps and curb cuts must be included-
c Culverts, Pipes and Drainage Structures - Display the installed type of drainage structure.

ALBEMARLE LAND DEVELOPMENT LLC is the owner (the "Owner") of Tax Map and Parce.
Number 032AO-02-00-00200 (the "Property") which is the subject of rezoning application ZMA No.
201900010, a project known as "3223 PROFFIT ROAD" (the "Project").
Pursuant to Section 33.3 of the Albemarle County Zoning Ordinance, the Owner hereby voluntarily
proffers the conditions listed below which shall be applied to the Property if it is rezoned. These
conditions are proffered as a part of the requested rezoning and the Owner acknowledges that the
conditions are reasonable. This proffer statement amends the proffers applicable to the Property that
were accepted in conjunction with ZMA2018-00006.
The Property shall be developed in general accord with the Zoning Map Amendment Concept
Plan prepared by Shimp Engineering, dated June 17, 2019 revised September 8, 2020 and shall
reflect the following major elements as shown and noted on the plans:
1. The internal street network grid and interparcel connections between the subject parcel,
and TMPs 03200-00-00-02000 and 032AO-02-00-001BO;
2. Right-of-way reservation and associated improvements along Proffit Road;
3. A minimum of 44 total dwelling units shall be developed on the property. The total
maximum number of dwelling units on the property shall not exceed 80.
4. A 25' Undisturbed Buffer adjacent to TMP 032AO-03-OB-00200, TMP 032AO-03-OB-
00400, and TMP 03200-0000-03000 as shown on the Conceptual Site Layout. Minimally
Disturbed Buffers of the approximate size and in the locations shown on the
Conceptual Site Layout:
a. Undisturbed Buffer allows for the removal of brush and/or dead vegetation.
b. Minimally Disturbed Buffers allow for minimal grading and/or the removal of
brush and/or dead vegetation.
5. Garage Setbacks - Single-family attached and single-family detached units located
