Remanded AP- 2005 -004 Van der Linde Housing, Inc. (owner /appellant)
Tax Map 45C, Section 2, Parcels 3, 4, 4A and 4B
Dear Mr. Klug:
At their meeting on April 10, 2007, the Board of Zoning Appeals voted 5 -0 to modify the
Zoning Administrator's determination dated February 18, 2005. The Board found upon
remand of the Albemarle Circuit Court that the use by the appellant in the Woodbrook
Shopping Center is "machinery and equipment sales, service and rental," a use
permitted by right in the PDSC Zoning District. This use decision is as submitted by the
appellant and concurred to by the County's Zoning Administrator.
The Board further found that is no longer necessary to find the use and definitions in
the original determination (to conclude or not conclude that the appellant's use is a
contractor or a contractor's storage yard).
