Dear Ms. Dudley: You have asked for a letter that provides an analysis of the zoning regarding the referenced properties. This letter is based on a review of our zoning records. All of the subject parcels are located in the Rural Areas (RA) Zoning District. For those parcels under Tax Map 102: ■ Parcel 35A contains 81.10 acres with 10 outbuildings of agricultural uses. A special use permit was approved for a helipad on July 16, 1986. The approval letter with conditions for SP -1986-33 is enclosed. ■ Parcel 35B contains 60.031 acres and one dwelling. ■ Parcel 37 contains 77.037 acres and one dwelling. ■ Parcel 37P contains 2.022 acres and one dwelling. ■ Parcel 39 contains 94.260 acres and one dwelling. Ms. Erin Dudley May 16, 2007 Page 2 Parcel 1 B contains 85.650 acres and no dwellings. There are improvements located on the parcel including a chapel, mausoleum, outbuilding with basement, patio and a bell tower. ■ Parcel 1 C contains 1.410 acres with one dwelling. Parcel 1 E contains 327.990 acres and has one dwelling and seven farm buildings. Our records indicate that three of these buildings contain offices. In 1974 a special permit, SP -74-398, was approved to allow a mobile home on Parcel 1 E. Manufactured homes are now allowed by right in the RA district. On February 17, 1987 the Board of Zoning Appeals approved a variance, VA -86-53, to reduce the front setback from 75 feet to 58 feet to allow the construction of the gate house. ■ Parcel 1 F contains 3.010 acres and one dwelling. ■ Parcel 1 G contains 4.140 acres and one dwelling. Parcel 10A contains 20.404 acres and is developed as the Albemarle Farm Store. This use is designated as farm sales and is permitted by special permit in the RA district. The Board of Supervisors approved SP -2001-055 on February 20, 2002. A copy of the approval letter with conditions is enclosed. This use is also subject to the supplemental regulations contained in Section 5.1.35. The site is developed in accord with the site development plan approved on January 31, 2002.
