RE: Zoning Confirmation 2400 Hunters Way, Charlottesville, Virginia 22901: Tax Map 79, Parcel 4C (the "Property") Gentlemen: Fax (434) 972-4126 In response to your request concerning the above referenced parcel's compliance with applicable codes, regulations and ordinances, please be advised as follows: ■ The County of Albemarle is responsible for (a) enforcement of building codes, zoning ordinances and similar codes or ordinances related to commercial development in the County of Albemarle and (b) along with the Building Official, is responsible for the issuance of certificates of occupancy in the County of Albemarle; Certificates of Occupancy have been issued and are in effect for all buildings at the Property and we are not aware of any circumstances which would render the certificates of occupancy invalid or cause them to be revoked; The Property is zoned Light Industrial (LI) and Entrance Corridor Overlay District (EC) under the laws or ordinances of the County of Albemarle. The property was rezoned from Highway Commercial (HC) to (LI) by ZMA-1986-9 which was approved December 17, 1986. A copy of the action letter with proffers is attached. Also attached as Exhibit "B" are true copies of the applicable ordinances, resolutions or regulations relating to the zoning and use of the Property; C:AProgramData\UnityECM\O1dDoclmporter\localcopy.doc As a condition to the issuance of the certificates of occupancy in the County of Albemarle a commercial property must comply with all applicable codes and ordinances including, but not limited to, building codes, any regulations pertaining to any entry sign board, fire department codes and regulations, applicable zoning laws, landscaping and parking requirements, obtaining appropriate curb cut permits and provisions for applicable sanitary sewer, water, storm drainage and other utilities. The structure was built under SDP 1996-30 and was issued a Certificate of Occupancy on September 12, 1996. The site plan was later amended by SDP 2002-76 and approved July 25, 2002. The addition was later constructed and issued a CO on September 6, 2002. The issuance of the certificates of occupancy for the Property is evidence that the conditions set forth have been satisfied at the Property. On June 27, 2007 a site inspection was conducted. At that time the property and the improvements thereon (a) are not in violation of the aforesaid building and zoning laws, rules and regulations, and (b) comply with all requirements with respect to on-site parking and landscaping. We understand that any mortgage lender for the Property may rely on this certificate. Sincerely, William D.
