This special use permit was approved based on the following conditions: 1. Special Use Permit 2007-11 shall be developed in general accord with the concept application plan and building details, provided by the applicant and received February 26, 2007 (Attachment A). However, the Zoning Administrator may approve revisions to the concept application plan to allow compliance with the Zoning Ordinance; 2. The picnic pavilion shall be limited to eight hundred (800) square feet and shall not include bathroom facilities or vehicular access; 3. The area of assembly shall be limited to a maximum one hundred ninety-five (195) seat sanctuary; occasional church gatherings beyond the normal capacity of the sanctuary shall be permitted; 4. There shall be no day care center or private school on site without approval of a separate special use permit; and 5. Construction of the eight hundred (800) square foot picnic pavilion shall commence within five (5) years or this special use permit shall Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: compliance with conditions of the SPECIAL USE PERMIT; approval of and compliance with a SITE PLAN; and approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within sixty (60) months from the date of Board approval, it shall be deemed abandoned and the permit terminated. The term "commenced" means "construction of any structure necessary to the use of the permit."
