Subject: SUB 2007- 236 SPOTNAP ROAD /PUBLIC RD PLANS
I have finally pulled together everything on this and think I understand what is going on
The road plans are approved to convert from a private to a public street. The document
submitted for this transfer was titled a subdivision plat, however it really isn't a subdivision plat. It
doesn't transfer the land or reduce the acreages of the parcels from which the ROW is coming it
is really a road plan.
Here is what I think needs to be done. In order for the road to be accepted the issues identified
by VDOT need to be addressed (I have copied Joel's email and attached it below) and a plat
needs to be submitted that delineates the ROW to be dedicated and the resulting lot size
reduction. However, in looking at the road plan it appears that in D.B. 3350 Page 729 (735 plat)
that the street was dedicated. My records (SUB 2006 — 299, 300 and 301) don't show a right of
way dedication but only a sewer dedication and other easements. I do not have D.B. 3350 Page
729 (735 plat) but will get it. If the area was dedicated by that document I think we are done. If
not I am somewhat concerned that I do not believe that the existing parking areas will meet a 10
foot setback from the new ROW. I am coming into this cold so if I am bringing up things that have
been dealt with previously just let me know. I can't find anything that addresses them.

Max,
have reviewed the Spotnap plan and everything looks good on it. A permit will be needed for
the work within the South Pantops Drive ROW. We will need to get an agreement for the small
section of sidewalk in front of the Spotnap Land Trust building, TMP- 78 -15C7, for maintenance
since the sidewalk is half in the proposed ROW but that can be done at the time the road is being
brought into the secondary system. If possible, it would be easier to get this section in with the
new section that is under construction and accept it all at the same time.
