The only outstanding issue for final approval and signature copies of the plat is VDH approval. I'll send

Thank you for putting me in touch with Bill about the lot. He and I had a chance to review the lot
configuration and the comment about original notes 3 and 4. The client has reviewed the most
current version of the plat and approved it. Per your comments dated on January 13, 2021 for
SUB202100184 Scuffletown LLC Subdivision, I offer the following responses:
1. f14-308.11 Groundwater assessment. Provide groundwater assessment fee ($355) to initiate a
Tier2 groundwater assessment. The fee must be paid prior to plat approval. Comment
oddressed fee poid 07105122.
• Acknowledged.
2. [14-302.A.10] Right of further division of proposed lots. Note regarding development rights
should read as follows: Lot 3 is assigned 1 development right and may not be further divided.
When used, the development rights shall be within their December 7980 boundaries. Comment
addressed: note added to plat.
• Acknowledged.
3. (14-3028.7] Agricultural and forestal districts. Amend note to state that the property is not
located within an Ag Forest district. TMP 736-9 was recently removed from the Hatton Ag Forest
District (GIS layer has not been updated). Comment partially addressed: note revised. Applicant
is advised to edit notes #3 and #4 so that the note reference numbers align properly with the
adjacent zoning notes.
The original notes 3 and 4 have been consolidated. .
4. [14-302.8.70] The location of stream buffers required by the water protection ordinance, with the
following note: "The stream buffer(s) shown hereon shall be managed in accordance with the
Albemarle Countv Water Protection Ordinance." Comment addressed: note added

5. [14-309, 14-370, and 14-476] Soils evaluations. The subdivider shall submit to the agent with
each final plat the results of percolation tests or other methods of soil evaluation used to
determine the suitability of the soil for subsurface drainfields. Comment partially addressed.
Applicant has submitted VDH letter dated 08175176 containing previously submitted soils
information and a septic permit, which expired 02174178. The information has been resubmitted
to VDH; pending VDH comments will be forwarded upon receipt.
• Acknowledged.
6. (14-309, 18-4.2.2, 4.2.2.A.11 Drainfield location and building site. The drainfield must be located
within the property boundaries of the proposed lot. Comment partially addressed. The revised
plat submitted 12121121 shows the drainfield located within the property boundaries of the
proposed lot. However, the lot configuration does not meet the criteria of Sec. 4.2.2.A.7 regarding
building site, which states: Each building site for a dwelling unit shall have an area of 30,000
square feet or greater and shall be of such WWWALBEMARLE ORG 401 McIntire Road, North
Wing, I Charlottesville, VA 22902-4579 dimensions that no one dimension exceeds any other by
a ratio of more than five to one as described by a rectangle inscribed within the building site.
The building site shall have adequate area for locating two subsurface drainfields approved by
the Virginia Department of Health if the lot will be served by a conventional onsite sewage
system.

of Transportation (VDOT) for review and approval of the proposed entrances onto public streets.
Comments will be forwarded upon receipt. Comment addressed. see VDOT approval letter

8. [14-302.B.7] General information. Update the plat revision date.
The revision date has been updated.

David, I've attached revised comments for this subdivision.
The biggest issue remaining is the lot configuration, which does not meet the standards of 4.2.2.A.1.
I'm also awaiting VDH response about the soils since the septic permit they previously issued for this
property expired a couple of years ago.
