In the spring of 2020 my mother - Mae E Finley - who owned appx 85 acres and a home at 5289 Free Union Rd - desired to sell her house and appx 25 acres. After conferring with the county we were informed that the best solution was to join her property to mine - John W Finley at 5281 Free Union Rd.. My property was 35 acres and a house. This was done and her house and 25 acres were divided off and sold. We then needed to return the remainder of her property to her and all of my property tome. Earl Motley did the survey and plat and turned all into the county this summer. There were questions we answered but just when we thought all was done we were informed that the remainder of my mother land -which had no house -would need to be perk tested. This was done in August, Mr Motley prepared anew plat and sent it and soil reports to your office. For some reason the soil reports did not go to the health department until last week. We now have pending contracts on both my mothers land and mine. I need to know exactly the steps needed to finish the division, file and record the final deeds, as well as a timeline. This is critical to both of the sales which are likely to fall through with a lengthy delay.. As far as what needs to be done, without knowing all of what is going on with the review, it looks like 1) the soils packets (he sent to me and forwarded to you on 10/13) need to be submitted to VDH, 2) the VDH needs to review them, and 3) we can't control their timeline. Cameron can confirm when he may have received it and when he forwarded to the Virginia Department of Health (VDH) for their review. Please note that the VDH has their own review timeline and cycle that the County cannot control. It is not uncommon for that to take 30 or more days from when they receive the soils packet. In 2020 a MIT Brent nelson initially began assisting with the division of land owned by Mae E finley of 5289 Free Union Rd. We were attempting to sell - a 25 acre parcel with a house on a property of larger acreage owned by Mae E Finley. To do this, Mae's entire property (- 65 acres) was joined to mine Qohn Finley, 5281 Free Union Rd. 35 acres) . The property of - 25 acres with the house (5289 Free Union Rd) was then split off as a separate parcel and sold. I (John Finley, 5281 Free Union Rd) was then left with - 75 acres that needed to be split and 39 acres given back to my mother. This was sent to the county this summer - we received comments that we answered but then were told that the health department required perk tests on the 39 acres to be split off. The perk tests were done in August; a Mr Earl Motley drew up the plat and sent it back to the county in early September. I contacted the health department but they have not seen the perk tests/plat. I have buyers for both parcels - we are waitting on this final division. How do I find a timeline for this? Whom do I speak to? This is most critical for me. I realize COVID made things difficult but this process has now gone on for almost two years, and it now endangers sale of both properties. This is because the Health Department is the agency that issues permits for wells and septic systems if a house ever gets built on the new lot in the future. Typically, anyone subdividing a piece of land provides the County a soils evaluation report that we then forward to staff at VDH. The staff at VDh review the soils report to determine whether a drinking well and septic system can be installed in the future. I've attached an example of a soils report that has been approved by VDH on another subdivision as an example. Sometimes the Health Department does not necessarily need a full soils evaluation report in order to evaluate the proposed subdivision and issue an approval. I was simply making the comment because that is what I am required to do by law. So, my suggestion is that you or your surveyor send a staff member over at VDH an email and ask if they can approve this subdivision request. If you can get me something in writing from VDH saying they approve the proposed subdivision, then that is all I need.
