staff last week. VDH typically takes about 5-10 business days to complete their reviews. They will email me once
they have finished their review, and they will either approve the soils reports, or issue comments if revisions or
further information is needed. Once I hear from them, I will contact you.
If VDH approves the soils reports, then your plat will be ready for County approval. I will let you know that you can
submit hard copies for signature and approval.

In the spring of 2020 my mother - Mae E Finley - who owned appx 85 acres and a home at 5289 Free Union Rd -
desired to sell her house and appx 25 acres. After conferring with the county we were informed that the best
solution was to join her property to mine - John W Finley at 5281 Free Union Rd.. My property was 35 acres and a
house.
This was done and her house and 25 acres were divided off and sold. We then needed to return the remainder of
her property to her and all of my property tome. Earl Motley did the survey and plat and turned all into
the county this summer. There were questions we answered but just when we thought all was done we
were informed that the remainder of my mother land -which had no house -would need to be perk tested. This
was done in August, Mr Motley prepared anew plat and sent it and soil reports to your office. For some reason the
soil reports did not go to the health department until last week.
We now have pending contracts on both my mothers land and mine. I need to know exactly the steps needed to
finish the division, file and record the final deeds, as well as a timeline. This is critical to both of the sales which are
likely to fall through with a lengthy delay..

In the spring of 2020 my mother - Mae E Finley - who owned appx 85 acres and a home at 5289 Free Union Rd -
desired to sell her house and appx 25 acres. After conferring with the county we were informed that the best
solution was to join her property to mine - John W Finley at 5281 Free Union Rd.. My property was 35 acres and a
house.
This was done and her house and 25 acres were divided off and sold. We then needed to return the remainder of her
property to her and all of my property tome. Earl Motley did the survey and plat and turned all into the county this
summer. There were questions we answered but just when we thought all was done we were informed that the
remainder of my mother land - which had no house - would need to be perk tested. This was done in August, Mr
Motley prepared anew plat and sent it and soil reports to your office. For some reason the soil reports did not go to
the health department until last week.

We now have pending contracts on both my mothers land and mine. I need to know exactly the steps needed to
finish the division, file and record the final deeds, as well as a timeline. This is critical to both of the sales which are
likely to fall through with a lengthy delay..

I did not forward anything to VDH for this plat. They never provided me with a soils report, just a plat showing a
drainfield location. I told them we needed actual soils evaluation reports to forward to VDH, in addition with the

likely to fall through with a lengthy delay..

Second, I had send another email the day after your email (attached) where he had forwarded to CDDlnquiry (and not

So hopefully you have (from the email I included you on-10/13) now received the missing soils reports and either have
or are about to forward those to the VDH for their review.
Third, now yet again today Mr. Finley is emailine CDD Inquiry instead of you asking what he needs to do to move
forward see 2"' attached email from 5:05PM today (10/18).
Question: Could you please reach out to Mr. Finley and answer his question from his today (attached) which is, "I
need to know exactly the steps needed to finish the division, file and record the final deeds, as well as a
timeline. This is critical to both of the sales which are likely to fall through with a lengthy delay.."
Each time I reach out to him and copy you, even when I say he needs to communicate with you, he sends emails in
response only to CDD Inquiry.
If possible I think CDD Inquiry needs to be pulled out of this equation.
I really don't know why he is not communicating with you.
As far as what needs to be done, without knowing all of what is going on with the review, it looks like 1) the soils
packets (he sent to me and forwarded to you on 10/13) need to be submitted to VDH, 2) the VDH needs to review them,
and 3) we can't control their timeline.
But I fear if I email him that he will yet again not communicate with you directly.

The soils percolation test reports were never sent to me. The last email correspondence I was CC'd on regarding this
plat is attached from September 20. It was a conversation between the surveyor, Mr. Earl Mottley, and Mr. Finley. The
surveyor provided plat exhibits that showed drainfield locations, but no soils percolation tests were provided. I spoke
with Travis David at the Virginia Department of Health earlier this afternoon, and he informed me that VDH never
received a soils percolation report for this plat either.

If SUB202100071 Division of the Property of John W. Finley— Rural Subdivision of TMP 17-16 is the one you are
referring to Cameron should be able to provide you with an update.
However, just to get the information started, what I see on our Application Tracking and Update (CountyView) system
is:
• It was initially submitted on 4/12/2021
• Cameron Langille is the Review Coordinator
• The last round of comments were provided to you or your consultant on 7/13/2021.
• The plat itself has not been resubmitted since those comments were provided (7/13/2021).
• If, as you stated, the soils packet (perk test and drainfield locations) was forwarded to Cameron in September by
Earl Motley, the submission of the soils packet would not show up on the CountyView system since it wasn't a
resubmission of the actual subdivision plat itself. Cameron can confirm when he may have received it and when
he forwarded to the Virginia Department of Health (VDH) for their review.
Please note that the VDH has their own review timeline and cycle that the County cannot control.
It is not uncommon for that to take 30 or more days from when they receive the soils packet.
But, as noted, Cameron should be able to give you more detail.

In 2020 a MIT Brent nelson initially began assisting with the division of land owned by Mae E finley of
5289 Free Union Rd. We were attempting to sell - a 25 acre parcel with a house on a property of
larger acreage owned by Mae E Finley. To do this, Mae's entire property (- 65 acres) was joined to
mine Qohn Finley, 5281 Free Union Rd. 35 acres) . The property of - 25 acres with the house
(5289 Free Union Rd) was then split off as a separate parcel and sold.
I (John Finley, 5281 Free Union Rd) was then left with - 75 acres that needed to be split and 39
acres given back to my mother. This was sent to the county this summer - we received comments
that we answered but then were told that the health department required perk tests on the 39 acres to
be split off.
The perk tests were done in August; a Mr Earl Motley drew up the plat and sent it back to the county
in early September. I contacted the health department but they have not seen the perk tests/plat.
I have buyers for both parcels - we are waitting on this final division. How do I find a timeline for
this? Whom do I speak to? This is most critical for me.
I realize COVID made things difficult but this process has now gone on for almost two years, and it
now endangers sale of both properties.

However, just to get the information started, what I see on our Application Tracking and Update (CountvView)
system is:
• It was initially submitted on 4/12/2021
• Cameron Langille is the Review Coordinator
• The last round of comments were provided to you or your consultant on 7/13/2021.
• The plat itself has not been resubmitted since those comments were provided (7/13/2021).
• If, as you stated, the soils packet (perk test and drainfield locations) was forwarded to Cameron in September
by Earl Motley, the submission of the soils packet would not show up on the CountyView system since it
wasn't a resubmission of the actual subdivision plat itself. Cameron can confirm when he may have received
it and when he forwarded to the Virginia Department of Health (VDH) for their review.
Please note that the VDH has their own review timeline and cycle that the County cannot control.
It is not uncommon for that to take 30 or more days from when they receive the soils packet.

In 2020 a MIT Brent nelson initially began assisting with the division of land owned by Mae E
finley of 5289 Free Union Rd. We were attempting to sell - a 25 acre parcel with a house on
a property of larger acreage owned by Mae E Finley. To do this, Mae's entire property (- 65
acres) was joined to mine (john Finley, 5281 Free Union Rd. 35 acres) . The property of - 25
acres with the house (5289 Free Union Rd) was then split off as a separate parcel and sold.
I (John Finley, 5281 Free Union Rd) was then left with - 75 acres that needed to be split and 39
acres given back to my mother. This was sent to the county this summer - we received comments
that we answered but then were told that the health department required perk tests on the 39 acres
to be split off.
The perk tests were done

I have buyers for both parcels - we are waitting on this final division. How do I find a timeline for

now endangers sale of both properties.

In 2020 a Mrr Brent nelson initially began assisting with the division of land owned by Mae E finley
of 5289 Free Union Rd. We were attempting to sell - a 25 acre parcel with a house on a property
of larger acreage owned by Mae E Finley. To do this, Mae's entire property (- 65 acres) was
joined to mine (john Finley, 5281 Free Union Rd. 35 acres) . The property of - 25 acres with the
house (5289 Free Union Rd) was then split off as a separate parcel and sold.
I (John Finley, 5281 Free Union Rd) was then left with - 75 acres that needed to be split and 39
acres given back to my mother. This was sent to the county this summer - we received comments
that we answered but then were told that the health department required perk tests on the 39 acres
to be split off.
The perk tests were done in August; a Mr Earl Motley drew up the plat and sent it back to the
county in early September. I contacted the health department but they have not seen the perk
tests/plat.
I have buyers for both parcels - we are waitting on this final division. How do I find a timeline for
this? Whom do I speak to? This is most critical for me.
I realize COVID made things difficult but this process has now gone on for almost two years, and it
now endangers sale of both properties.

the completed survey was returned to the county with both drainfields on the plat in September. do ii need the
surveyor to send you the plat or does the county send it to you? I am confused as to who to go to and how to get

• The plat itself has not been resubmitted since those comments were provided (7/13/2021).
• If, as you stated, the soils packet (perk test and drainfield locations) was forwarded to Cameron in September by
Earl Motley, the submission of the soils packet would not show up on the CountyView system since it wasn't a
resubmission of the actual subdivision plat itself. Cameron can confirm when he may have received it and
when he forwarded to the Virginia Department of Health (VDH) for their review.
Please note that the VDH has their own review timeline and cycle that the County cannot control.
It is not uncommon for that to take 30 or more days from when they receive the soils packet.
But, as noted, Cameron should be able to give you more detail.

The soils percolation test reports were never sent to me. The last email correspondence I was CC'd on regarding this
plat is attached from September 20. It was a conversation between the surveyor, Mr. Earl Mottley, and Mr. Finley. The
surveyor provided plat exhibits that showed drainfield locations, but no soils percolation tests were provided. I spoke
with Travis David at the Virginia Department of Health earlier this afternoon, and he informed me that VDH never
received a soils percolation report for this plat either.
If there are soils percolation reports available, please send those to me and I will forward to VDH staff for review.

Hi Mr. Finley,
The County's Subdivision Ordinance requires that anytime a new lot is being subdivided, the Health Director at the
Virginia Department of Health (VDH) must approve the proposed subdivision. This is because the Health Department is
the agency that issues permits for wells and septic systems if a house ever gets built on the new lot in the
future. Typically, anyone subdividing a piece of land provides the County a soils evaluation report that we then forward
to staff at VDH. The staff at VDh review the soils report to determine whether a drinking well and septic system can be
installed in the future. I've attached an example of a soils report that has been approved by VDH on another subdivision
as an example.
Sometimes the Health Department does not necessarily need a full soils evaluation report in order to evaluate the
proposed subdivision and issue an approval. I was simply making the comment because that is what I am required to do
by law.
So, my suggestion is that you or your surveyor send a staff member over at VDH an email and ask if they can approve
this subdivision request. If you can get me something in writing from VDH saying they approve the proposed subdivision,
then that is all I need.
The two staff members over at VDH that I would recommend contacting at Travis Davis and Josh Kirtley. Their emails
are as follows:

Road. I have seen messages and it seems that what I now need is something from the county health department? Can
you please explain? We have never run into this although we have been doing land divisions in this area for the past 40
years. Moreover my father was an engineer and head of the county board for a number of years and I never heard of
fit from him, so I am rather ignorant of what I need and why.
This parcel that is having the boundary line adjustment is returning the land to the exact boundary that has existed
almost 100 years. There are no new houses or roads. When we started this process (almost 1 1/2 years ago) I met with
a county planner and was told to do it this way. We are now in the middle of a potential sale and this could collapse
that.
Can you please explain to me what I need, why I need it and exactly whom to speak with. I would like to come to
Charlottesville next week and take care of this.
