The Planner for the Planning Services Division of the Albemarle County Department of Community Development
will recommend approval of the plan referred to above when the following items have been satisfactorily
addressed. (The following comments are those that have been identified at this time. Additional comments or
conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable
reference to the Albemarle County Code.]
1. [General Comment] The final site plan for Rivanna Village Phase 2B must be approved prior to approval of this final
subdivision plat. Additional comments may be provided on the subdivision plat based on the final layout and design
of the approved site plan. Comment still applies.
2. [General Comment] The final plat for Rivanna Village Phase 2A must be approved and recorded prior to final
approval of this plat. Comment still applies.
3. [General Comment] There appear to be several "I" lots missing. Clarify where those lots are. Are they proposed to
eventually be located in the "residue" parcel? Comment addressed.
4. [34-302(A)4; 14-302(A)5] Ensure all the easements that were approved with the easement plat SUB2021-00057
are identified with the appropriate deed book and page numbers on this plat. Comment addressed.
5. [34-302(A)3] Cattail Court needs to be identified as a private street, and meet private street standards, in order to
provide frontage for those parcels in Block G. Comment addressed.
6. [34-302(A)11] Provide the deed book and page number for the plat that created existing parcel 93A1-4R1.
Comment addressed. Phase 2A will need to be added when that plat is approved.
7. [34-302(A)14; 14-427] The community park should be "reserved" for Albemarle County, not "dedicated" at this
time. See comments from Parks and Rec for more information.
Also, break out the acreage of the community park from the other open space areas in the table on the cover sheet,
as the community park will be publicly owned in the future, while the other open space areas will remain privately
owned. Comments addressed.
8. [14-302(B)1] Provide the date of last revision of the plat on all future submittals. Comment still applies to future
re -submittals.
9. [14-302(B)30] Lots cannot be located within the stream buffer. Remove the lots from the stream buffer, or provide
information where an exception was granted allowing the lots to be located within the buffer. (Lots J34-J38 and
Lot J48.) Comment addressed.
10. [14-317] Identify who will own and be responsible for the proposed private right-of-way in Block G, as well as the
open spaces not reserved for the County (Open Spaces A-H). HOA documents that comply with the requirements
of 14-317 must be provided to County staff for review and approval prior to the approval of this plat. These
documents will then need to be recorded along with the subdivision plat once everything has been granted final
approval. Comment still applies. HOA documents to be reviewed by staff and approved with plat when the plat is
ready.
11. New Comment: There were still a few areas with text overlaying other text. Please ensure these typos are fixed
prior to next submittal.
12. New Comment: In researching the history of this property, there appears to be a recorded access easement
(Cumbria Lane) on the eastern side of proposed Open Space F that provides access from Route 250 to several
adjacent properties, such as that owned by Darrell and Darla Ullery. This easement does not appear to have been
depicted on this plat. Please ensure this easement, and any other appropriate information, is depicted on the plat.

John Anderson, ianderson20albemarle.org - Requested changes; seethe comments below:
1. It appears possible C64 is not labele (Rev. 1) Withdrawn; review error.
2. C35 and C37 appear twice (Lot J2, Lot J3, V3; entrance /curve, Cattail Co (Rev. 1) Addressed.
3. Cannot locate C5, C6. Please direct reviewer to these curs (Rev. 1) Addressed.
4. Please revise numerous DB XX PG XX references with reference to Easement Plat at DB 5619 PG 506, whenever
appropriate. (Rev. 1) Addressed.
5. Phase 2B of approved ROAD Plan (SUB201900156; Approved 10/8/21) must be built or bonded prior to Phase 213
subdivision plat approval. (Rev. 1) Persists. Applicant response( letter d. 12/16/21):'... checked with the developer and
they have indicated that they are waiting on the bond amount from the county and will likely wait until base coat of
asphalt is installed prior to bonding any of the remaining improvements.' As follow-up: Developer indicates preference
to wait (delay posting Phase 2B ROAD Plan bond) in e-mail exchange with Albemarle County until specific (bond
estimate) line items are complete (Also: email, Albemarle to Applicant, w/Attachments: December 21, 20214:47 PM).
Improvements must be constructed to VDOT standards (or retaining wall design) to qualify for a lower initial Phase 2B
ROAD plan bond estimate. Material test reports /inspection reports /pipe video are required to cover multiple
sidewalk /curb -gutter /pavement /pipe /drainage bond items, before estimate/s for these typical road plan bond items
may be adjusted downward.
6. New: Roads in Phase 2A must be fully constructed and inspected before SUB202100160, Phase 2B Final Plat can be
approved. Ref. SUB201900156, Approved ROAD Plan, sheet 4 Note.'
