Thank you, Cameron. We sent the plats to the lender for signature in a standard Fed Ex mailing tube and they
were gently rolled up to prevent damage and to avoid folding them. The lender received them that way,
signed them, and returned them in the same mailing tube. But when we received it the next day, it looked like
it had quite literally been run over by the FedEx truck or some other large vehicle —completely flat. Justin
case anyone was wondering!

Chris,
I have reviewed the revised plat in regards to the language contained under the Conservation Easement Division Rights
section. I believe that the current language is not terribly problematic but it does contain some wording that seems to
muddy the waters a bit. I would suggest the following language below in relation to VOFs interest in the property being
stated in this section. Not to get too much in the weeds but VOF actually holds open space easements due our status as
a state agency holder which essentially means we hold under the open space legislation whereas non-profit holders
would hold conservation easements which are held under a different state legislation. As you might know, Albemarle
County also holds under the open space easement statue. The two terms are commonly used interchangeably so I used
the term open space easement in my revisions below but I really don't have any qualms with using conservation
easement if that is preferred.
Tax Map 65 Parcel 84B and Parcel 8461 are held in open space easement with the Virginia Outdoors Foundation
as recorded in Deed Book 3101 Pages 462-475 in the Albemarle County Clerk's Office. Section 3 of the Deed of
Easement, DIVISIONS, states:
The Property shall not be divided or subdivided into, or separately conveyed as more than three (3) parcels.
Boundary line adjustments with adjoining parcels of land are permitted and shall not be considered a prohibited
division of the Property, provided that the Grantee is made party to the applicable deed of any such boundary
line adjustment and one of the following conditions is met: (i) the entire adjacent parcel is subject to an existing,
recorded open -space easement conveyed to the Grantee, or (ii) the proposed boundary line adjustment is
reviewed and approved in advance by the Board of Trustees of the Grantee.
Pursuant to the terms and conditions of the Deed of Easement, one further subdivision would be allowed to be
undertaken on either, but not both, Revised Tax Map 65 Parcel 84B or Tax Map 65 Parcel 84B containing
371.128 acres as shown heron to create a separate third parcel, subject to the Development Right Allocation
shown hereon, and the terms and conditions of the open space easement.
I am open to input on the language if the County or the landowner's legal representation has any issues or concerns with
the suggested revisions.

I have reviewed the revised plat in regards to the language contained under the Conservation Easement Division Rights
section. I believe that the current language is not terribly problematic but it does contain some wording that seems to
muddy the waters a bit. I would suggest the following language below in relation to VOFs interest in the property being
stated in this section. Not to get too much in the weeds but VOF actually holds open space easements due our status as
a state agency holder which essentially means we hold under the open space legislation whereas non-profit holders
would hold conservation easements which are held under a different state legislation. As you might know, Albemarle
County also holds under the open space easement statue. The two terms are commonly used interchangeably so I used
the term open space easement in my revisions below but I really don't have any qualms with using conservation
easement if that is preferred.
Tax Map 65 Parcel 84B and Parcel 84131 are held in open space easement with the Virginia Outdoors Foundation
as recorded in Deed Book 3101 Pages 462-475 in the Albemarle County Clerk's Office. Section 3 of the Deed of
Easement, DIVISIONS, states:
The Property shall not be divided or subdivided into, or separately conveyed as more than three (3) parcels.
Boundary line adjustments with adjoining parcels of land are permitted and shall not be considered a prohibited
division of the Property, provided that the Grantee is made party to the applicable deed of any such boundary
line adjustment and one of the following conditions is met: (i) the entire adjacent parcel is subject to an existing,
recorded open -space easement conveyed to the Grantee, or (ii) the proposed boundary line adjustment is
reviewed and approved in advance by the Board of Trustees of the Grantee.
Pursuant to the terms and conditions of the Deed of Easement, one further subdivision would be allowed to be
undertaken on either, but not both, Revised Tax Map 65 Parcel 84B or Tax Map 65 Parcel 84B containing
371.128 acres as shown heron to create a separate third parcel, subject to the Development Right Allocation
shown hereon, and the terms and conditions of the open space easement.
I am open to input on the language if the County or the landowner's legal representation has any issues or concerns with
the suggested revisions.

I have reviewed the revised plat in regards to the language contained under the Conservation Easement Division Rights
section. I believe that the current language is not terribly problematic but it does contain some wording that seems to
muddy the waters a bit. I would suggest the following language below in relation to VOFs interest in the property being
stated in this section. Not to get too much in the weeds but VOF actually holds open space easements due our status as
a state agency holder which essentially means we hold under the open space legislation whereas non-profit holders
would hold conservation easements which are held under a different state legislation. As you might know, Albemarle
County also holds under the open space easement statue. The two terms are commonly used interchangeably so I used
the term open space easement in my revisions below but I really don't have any qualms with using conservation
easement if that is preferred.

Tax Map 65 Parcel 84B and Parcel 84131 are held in open space easement with the Virginia Outdoors Foundation
as recorded in Deed Book 3101 Pages 462-475 in the Albemarle County Clerk's Office. Section 3 of the Deed of
Easement, DIVISIONS, states:
The Property shall not be divided or subdivided into, or separately conveyed as more than three (3) parcels.
Boundary line adjustments with adjoining parcels of land are permitted and shall not be considered a prohibited
division of the Property, provided that the Grantee is made party to the applicable deed of any such boundary
line adjustment and one of the following conditions is met: (i) the entire adjacent parcel is subject to an existing,
recorded open -space easement conveyed to the Grantee, or (ii) the proposed boundary line adjustment is
reviewed and approved in advance by the Board of Trustees of the Grantee.
Pursuant to the terms and conditions of the Deed of Easement, one further subdivision would be allowed to be
undertaken on either, but not both, Revised Tax Map 65 Parcel 84B or Tax Map 65 Parcel 84B containing
371.128 acres as shown heron to create a separate third parcel, subject to the Development Right Allocation
shown hereon, and the terms and conditions of the open space easement.
I am open to input on the language if the County or the landowner's legal representation has any issues or concerns with
the suggested revisions.

Thank you for sending the proposed boundary line adjustment (BLA) plat to the Virginia Outdoors Foundation (VOF) for
comment. The proposed BLA is internal to VOFs Deed of Easement (DOE) interest in the property acreage and is
therefore allowed as no specific size or location requirements pertaining to the allowed subdivided parcels is contained
within.
