Tax Map 65 Parcel 848 and Parcel 84B1 are held in open space easement with the Virginia
Outdoors Foundation as recorded in Deed Book 310l Pages 462-475 in the Albemarle County
Clerk's Office. Section 3 of the Deed of Easement, DIVISIONS, states: The Property shall
not be divided or subdivided into, or separately conveyed as more than three (3) parcels.
Boundary line adjustments with adjoining parcels of land are permitted and shall not be
considered a prohibited division of the Property, provided that the Grantee is made party
to the applicable deed of any suchboundary line adjustment and one of the following conditions
is met: (i) the entire adjacent parcel is subject to an existing, recorded open -space easement
conveyed to the Grantee, or (ii) the proposed boundary line adjustment is reviewed and approved
in advance by the Board of Trustees of the Grantee.
Pursuant to the terms and conditions of the Deed of Easement, one further subdivision would be
allowed to be undertaken on either, but not both, Revised Tax Map 65 Parcel 846 or Tax Map 65
Parcel 84B containing 371.128 acres as shown heron to create a separate third parcel, subject to the
Development Right Allocation shown hereon, and the terms and conditions of the open space easement.
