Considering the area is already impervious, this can fall under a maintenance exemption (repaving of existing or paving of impervious gravel) so long as there is not an increase in impervious area and the use is the same (parking and travel lane). A VESCP is still required for erosion and sediment control considering the land disturbance will be greater than 10,000 sf. Let me know if you have any questions or concerns. Frank V. However, we never formalized the wetland as a pro-rata basin. Stavros was recently advised by a DEQ staff that we could set it up as a nutrient bank instead of a pro -rate system. We'd be happy to move this forward on this ASAP but I'm not sure what the timing would be. So I'll need to know if and how the new storm water management regs would be applied; and if the new Crozet SWM basin we built would address any requirements from the new regs.
