Dear Frank,
We have received your comments dated 12/30/2021 and have provided the following
responses:
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code §17-405. A SWPPP is required
even though a SWM plan is not.
1. Single Family SWPPP not submitted. Provide a completed Single Family SWPPP. Please refer
to the following link for the Single -Family Home SWPPP template, which may be used for this
project.
RESPONSE: A single family SWPPP has been provided with this submittal.
B. Pollution Prevention Plan (PPP)
A PPP is required even though a SWM plan is not required. PPP content requirements can be found in
County Code §17-404.
1. PPP not submitted. Include PPP requirements on the plan sheets.
RESPONSE: PPP requirements have been provided with this submittal.
C. Stormwater Management Plan (SWMP)
VSMP Regulation §9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. A
SWM plan is not required for this project because the land disturbing activity is for the purpose of
establishing a single-family dwelling and the Administrator has determined an agreement in lieu of a
stormwater management plan is allowed [§17-403.13).
1. Submit a completed and executed SWM Agreement in Lieu of a plan form with this application. An
additional fee for this agreement is NOT required. Refer to the agreement linked below.
RESPONSE: A completed SWM Agreement in Lieu has been provided with this application.

D. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan
is disapproved for the reasons noted below. The erosion control plan content requirements can be
found in County Code §17-402.
1. Revise note on Sheet 1 stating "Limits if Disturbance...." to "Limits of Disturbance...". Also, add to the
end of "Qualifies for agreement in lieu of plan for SWM plan" the following: "because the driveway is
being constructed for the purpose of establishing the first single-family dwelling on the subject property
[§ 17-403. B]."
RESPONSE: The Limits of disturbance and the qualifying note has been updated with this submittal.
2. Show the area for each area of disturbance. Silt fence drainage areas must not exceed approximately
X acre per 100-ft of SF (VESCH). Sediment traps may be required where drainage areas exceed design
standards or at discharge points to the stream.
RESPONSE: The area of disturbance has been provided for each design standard. Modified mud traps
have been replaced where areas exceed % acre per 100-ft.
3. Silt fence should be installed parallel with contours (VESCH). Replace silt fence with diversions where
appropriate and add a typical diversion detail to the plan set.
RESPONSE: Silt fence has been provided parallel with contours. Diversions have replaced silt fence
where appropriate. The silt fence in the flood plain does not appear to be parallel with the contours
but the area is so flat that wrapping the area with silt fence seems the most logical way to prevent
disturbed areas from adding sedimentation downstream.
4. Add TS and PS symbols on plan where disturbance occurs and add the TS detail to the plan set
(VESCH).
RESPONSE TS and PS symbols have been provided with this submittal.
5. Driveway Typical section on Sheet 2 indicates 3:1 side slopes for the drainage channels but the detail
on Sheet 4 indicates 2:1 side slopes. Please reconcile.
RESPONSE The typical section has been updated to show 2:1 side slope.
6. Show the slope of the driveway on the plan and provide a note that the driveway cannot exceed 16%
[§ 18-4.6.6].
RESPONSE The slope of the driveway is less than 16%. A note has been added to the cover sheet.

7. It is suggested to confirm that the home site is large enough. Provide enough area for the actual home
that the owner wants to build, including outdoor areas, driveway pad, etc. If the area of land
disturbance exceeds 1 acre, a SWIM agreement in lieu of a plan may still be allowed considering the
purpose of this disturbance is for the establishment of a single-family home [§17-403.B]. It is
recommended to provide as much area as is needed for the home site so that additional grading of the
hillside is not required later. The VSMP fee is the same for LDAs under 5 acres if for the purpose of
establishing a single-family home [§17-208].
RESPONSE: The area of the home site has been vetted at 30'xS0' and there will not be more
disturbance as a part of this plan.
8. Add "Related approvals: FDP202100003" to the floodplain note on Sheet 1.
RESPONSE: Related approvals have been added to the cover sheet.
9. Provide a section of each bridge to clearly show and note that no work is to occur within the stream
banks.
RESPONSE: Bridge sections have been provided. The VMRC permit allows encroachment in, on, or
over state-owned subaqueous bottoms pursuant to Chapter 12, Subtitle III, of Title 28.2 of the Code of
Virginia. An email has been provided by the adjacent landowner Jim Barbour to use his land (TMP 7-
11) to access (7-29A) in order to install the bridges.
10. Explain how construction of the bridges will be completed without having to drive through the
streams. Submit a copy of the ACOE permit with this application. If access will be provided by some
other means, indicate this on the drawings.
RESPONSE: The VMRC permit allows encroachment in, on, or over state-owned subaqueous bottoms
pursuant to Chapter 12, Subtitle III, of Title 28.2 of the Code of Virginia. An email has been provided
by the adjacent landowner Jim Barbour to use his land (TMP 7-11) to access (7-29A) in order to install
the bridges.
11. Confirm matchlines are correct. Matchline on Sheet 2 references Sheet 3. Should the upper'window'
reference the lower'window', and the lower'window' reference Sheet 3 on the right side of the plan?
Sheet 3 doesn't show a matchline.
RESPONSE: Matchlines have been updated with this submittal.
12. Just for information, there are typos in the notes on Sheet 3.
RESPONSE: Typos have been remedied with this submittal.
13. Show the limits of the stream buffer on Sheet 4.
RESPONSE: The limits of the stream buffer have been shown on sheet 4.

14. Add "WPO202100068" to the cover sheet.
RESPONSE: WPO202100068 has been provided on the cover sheet.
E. Mitigation Plan (MP)
1. Combine the mitigation plan with the ESC plan set. Add the mitigation sheets to the sheet list and
update sheet numbers accordingly. Revise the title of this drawing set to be "Erosion & Sediment
Control Plan and Mitigation Plan." This makes it easier for inspectors to have one set of drawings in the
field to use for inspections and recordkeeping.
RESPONSE: The mitigation plan has been combined with the E&SC plan for this submittal.
2. Add a column to the tables on Sheet 2 identifying which plants are canopy trees, understory trees,
and shrubs. Provide a table/calculation showing that the ratio of these plants meets the ratio as noted in
Appendix D of the Riparian Buffers Guidance Manual.
RESPONSE: Rows have been added to each planting area scheduled identifying which plants are
canopy trees, understory trees and shrubs.
3. Include page C-1 from Appendix C of the Riparian Buffers Guidance Manual in the plan set. Link to the
manual.
RESPONSE: Page C-1 from Appendix C of the Riparian Buffers Guidance Manual has been provided
on sheet S.
