As the owner/applicant I certify that any delinquent real estate taxes, nuisance charges,stormwater management utility fees, and any other charges that constitute a lien on the subject property,which are owed to the County of Albemarle and have been properly assessed against the subject property, have been paid. Please be aware that the board shall grant a variance if the evidence shows: (i) That strict application of the terms of the ordinance would unreasonably restrict the utilization of the property; (ii) That granting the variance would alleviate a hardship due to a physical condition relating to the property or due to improvements thereon at the time of the effective date of the ordinance; and (iii) All of the following: 1. Good faith acquisition and hardship not self-inflicted.The property interest for which the variance is being requested was acquired in good faith and any hardship was not created by the applicant for the variance. 2. No substantial detriment. Granting the variance will not be a substantial detriment to adjacent property and nearby properties in the proximity of that geographical area. 3. Condition of situation not general or recurring.The condition or situation of the property is not of so general or recurring a nature as to make reasonably practicable the formulation of a general regulation to be adopted as an amendment to the ordinance. Grand Home has a free standing sign on the property.The sign is dated and time has made the location of this sign virtually useless. It is not visible based on vegitation on ajacent property and the property elevation. The property line/Right of Way line in front of Grand Home comes to the edge of the parking area.The current sign would be in violation of set back requirements if it were erected today. We are proposing a sign that is more modern, shorter, and located in the only place that is visible and won't require loss of parking.The location requested in in curb cut area that is challenged with utilities but will allow foundation for the sign.The edge of the sign would be 6" from the front property line. (i)The set back ordinance is well intended and well founded in logic. In this instance with the property line so far back from the street front the nessasity for the set back is diminished as the sign is approximately 30 feet back from the street and no possible visibility obstruction is present. Strict enforcement denies a large free standing retailer with any effective free standing sign identification. (ii)The variance will allow the property to overcome the lack of identification caused by time and growth. It is reasonable and in keeping with the spirit of the ordinance and the hardship is due to the specifics of the property caused over time with growth of vegitation and change of highway right of way lines. (iii) 1.The property has been in the hands of Grand Furnishings for many years and the changes requiring variance are external rather than self created. 2. Rather than a detriment the sign suggested should enhance traffic for those looking for the store and enable adjacent properties with joint entrance drive to benifit from lack of confused drivers. 131 Henderson Drive•Bluefield, WV 24701 3.The layout of the facility, parking area in front of the store,vegitation growth, and changing Right of Way are unique characteristics that are unique to Grand Home Furnishings.
