Subject: variance
Marty;
The Board of Zoning Appeals meeting is now only one week away. If you and your client are going to withdraw the
variance request we need that in writing(email is fine)TODAY. We have run the legal add and scheduled the meeting. I
have written my staff report to present to the Board of Zoning Appeals.We are recommending denial of the variance
because a variance is not needed to erect the sign in the proposed location.
Please send us something in writing today.
Thanks
Stewart Wright

Marty;
I'm going over to Grand Home Furnishing tomorrow and placing a stake in the median that will mark the edge of the
VDOT right of way. Hopefully you or your client can look at it and tell me if this solves the problem.
Thanks

Okay. We will proceed forward, but I do think you are getting ahead of yourself. It is really important that your customer
begins serious conversations with the Service Authority. I have seen variances approved before for sign locations that
were later denied by the Service Authority.

Thank you. I will have Grand Home Furnishing institute the conversation about the possible move.
I have had utilities marked at the property and while close I believe we are OK. Please proceed with the
application.

Okay. You and your customer should be talking to the Service Authority about that idea. From what I saw on their
computer the sign will be on top of their water line.

I am not certain that the water line is under the footer but it is close. My customer is willing to relocate the
water line if needed.

Subject: Variance for Grand Home Furnishing
Marty;
I am looking over the variance application for Grand Home Furnishings to make sure we have everything we need to
proceed forward. If anything is missing I will let you know.
I went out to the site 2 days ago to see the situation for myself and make sure there were no other good options for the
new sign location. I did some homework on the old sign and found a letter from the Albemarle County Service Authority
2
that states that the old sign is in their waterline easement and is permitted to be there. I am not sure if the new location
is in that same easement or not.The one thing I did see out there that is a huge concern for me was a fire hydrant very
close to the new sign location.That, plus the waterline easement, could make the new sign location not approvable.You
absolutely need to contact the Albemarle County Service Authority about the water line nearby and make sure the new
sign is not going to be in their easement. Even more important—you need to contact the Albemarle County Fire
Marshall and make sure they are okay with the sign being that close to their fire hydrant. They usually don't want
anything within 20 feet of a hydrant. Please contact those 2 agencies. It would be terrible to go all the way through the
variance process and then find out the sign can't go in that location even if the variance gets approved.
I would also recommend that you come up with a Plan B design that would make the sign narrower and taller so that it is
more than 6 inches from the property line. Having a backup plan is a good idea if the Board of Zoning Appeals is
uncomfortable with approving a 6 inch setback. The freestanding sign can be up to 12 feet in height.
Thanks
Stewart Wright
