VSMP Permit Plan Review

County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to act on any
VSMP permit by issuing a project approval or denial. This project is approved conditional upon SWM
facility easement recordation [SUB202100202; template easement deed cannot be formatted until SWM
Facility Maintenance Agreement is recorded]. The VSMP application content requirements can be found in
County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain
(1) a PPP, (2) an ESOP, (3) a SWMP, and (4) any TMDL measures necessary.
1. Replace on -site SWPPP, WP0201800044 Amendment # 1, with SWPPP submitted with Amendment #2
Application, once items at item 2., below, are addressed. (Rev. 1) Applicant: `Noted, this will be
completed.'
2. Also: (Rev. 1) Addressed.
a. Please revise Registration statement at p. of SWPPP/.PDF to indicate Application type is
Modification with acreage increase as this registration will be used to notify DEQ to increase
Estimated Area to be disturbed from current 4.50 Ac. to 5.40 Ac. (VAR10P436).
Note: DEQ will send request for payment of state permit fee to operator email listed at Sec. 1, B.
b. Revise SWPPP cover to reference Amendment #2.
B. Pollution Prevention Plan (PPP) —No request for revision to PPP Exhibit (Rev. 1) NA
The PPP content requirements can be found in County Code section 17-404.
C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. This
plan is approved.
1. Application Fee: $1,700 fee was received 12/14/2021. Fee for land disturbance 5 and less than 10 acres is
$2,004.08. Please submit $304.08 balance at earliest convenience. (Rev. 1) Addressed.
2. C5: Show discontinuous curb (curb cut) at Str. A4 if this structure is to receive parking lot runoff. (Rev. 1)
Addressed. Applicant response (letter d. 1/27/22): `This structure A4 is not intended to receive runoff,
rather it is an overflow measure for the BMP's.'

3. C6: Wherever storm runoff concentrates against curbing, provide and label CG-6. (Rev. 1) Addressed.
4. CT (Rev. 1) Addressed. Also, new comment at item 4.g., below, addressed via download link, 2/15.
a. Detail 8: Provide linework and label/s to indicate connection with BMP-L
b. Show building roof leader collection system connection with MH structures in storm drain profiles
at Str. CIA, D2, 132B, E2, etc. Provide leader line collection INV IN at MH structures to aid
construction and inspection.
c. Provide trash rack detail (weir plat orifices).
d. Provide step access for MH Str. A4.
e. Check 9.45' A4 detail vertical dimension, may need to revise to 8.45'.
f. Show Str. El to BMP-1 connection (use labels /linework).

5. Provide SWM facility easements. Easements must be reviewed, approved and recorded prior to
Amendment #2 approval. (Rev. 1) Persists, but review in process, rev. SLTB202100202 received 2/3/22.
6. C 17: Provide sheet title (ex.: Pre -development ground cover) to indicate sheet depicts pre -development
(existing) land cover since turf with limited forest approximates Amendment # 1 post -developed condition.
(Rev. 1) Addressed.
7. C20: Str. C IA spread appears excessive, recommend increase inlet throat length. (Rev. 1) Addressed.
Applicant: `CIA had inaccurately large drainage area to inlet (designed before roof drains were added), so
the LD-204 flow was reduced, therefore the spread is reduced and now reasonable without throat length
revision.'
8. Calculations /p. 2-3: Please submit exception request with $272 exception review fee. Copy narrative from
Calc. packet (p. 2-3) to separate exception request letter. Recommend refer to RGA design firm request, 23
Apr 2021, as an example, when requesting exception to 3.0" minimum orifice size. Use 1-year storm event
(not Q 1.5, Q2, Q10) for purpose of comparing various orifice DIAs with applicable Q 1 m� EB, and please
especially note proposed Ql p.�W,, PA2 (0.70cfs' orifice DIA=3.0"), state that 3.0" provides 92% of target
EBE-generated reduction, and last, please specify orifice diameter size otherwise required to meet EBE.
Engineering will likely not object to request, but exception request entails separate review /approval. (Rev.
1) Withdrawn. As follow-up (discussed 2/15: K. Rucker, J. Anderson), without a DEQ-sanctioned policy
concerning energy balance exception to allow 3" Min. orifice DIA when smaller diameter is required to
meet 9VAC25-870-66.B.3 (energy balance), Albemarle is unable to grant energy balance equation
exception, and may only approve (smaller) diameter required to meet EB. Structure A4 is amended to
show 2.9" DIA weir plate orifice.
9. Revise Calc. packet cover to reference Amendment 42. (Rev. 1) Addressed.
10. Plan proposes _ nutrient credit purchase. Purchase is not required for plan approval, but nutrient
credit purchase is required prior to commencing land disturbance unique to Amendment 42. (Rev. 1)
Nutrient purchase in process.
D. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan
is approved.
1. C2 (Rev. 1) Addressed.
a. Label Country Green Road, Old Lynchburg Road, and Mountainwood Road.
b. Provide deed bk.-pg, ref. to RW for public roads listed at item a., above.
2. C5: Please label outfall protection dimensions at Str. F 1: L x W x D. (Rev. 1) Addressed.
3. C 11: Paragraph with four itemized work activities (L-4.) under Project Description appears to reflect
WPO201800044 Amendment 1 activities, rather than apartment construction, update work activities, as
needed. (Rev. 1) Addressed.
4. C13: Show parking lot inlet protection (IP) in phase 2. Cl 1 sequence indicates curbing acts as diversion,
once curbing is installed in phase 2. (Rev. 1) Addressed. Applicant: `IP now added to Phase 2.'

a. Increase volume of STI, similar to increased volume under Amendment # 1, given proximity to
07600-00-00-046C 1 (Mountainwood Properties) and relative likelihood of off -site impact if Vol.
provided is barely > minimum Volume required. (Rev.1) Addressed. Applicant: `STI hasnow
been oversized by 20%.'
b. Provide sediment trap design data for Phase 1, trap 2. Volumes differ, elevations differ. (Rev. 1)
Addressed. Applicant: Phase 1 trap data ... now provided on C 12.'
Process
After approval, plans will have to be bonded. [An ESC plan bond amount is posted, but amount will be evaluated to
determine if amount is sufficient to cover Amendment #2 ESC measures. Further, SWM plan bond is required.]
The bonding process is begun by submitting a bond estimate request form and fee to the Department of Community
Development. One of the plan reviewers will prepare estimates and check parcel and easement information based on
the approved plans. The County's Management Analyst will prepare bond agreement forms, which will have to be
completed by the owner and submitted along with cash, certificates or sureties for the amounts specified. The
agreements will have to be approved and signed by the County Attorney and County Engineer. This may take 2-4
weeks to obtain all the correct signatures and forms.
A Stormwater Management Facility Maintenance Agreement will also have to be completed and recorded. The
County's Management Analyst or other staff will prepare the forms and check for ownership and signature
information. The completed forms will have to be submitted along with court recording fees.
(This project proposes nutrient credit purchase (91.64 lbs.) and requires SWM facility /SWM facility access
easements.
After bonding and agreements are complete, county staff will revise project information in a DEQ database for state
application processing (revise data for VAR10P436, increase Ac. from 4.50 to 5.40 Ac.). DEQ will review the
application information based on local V SMP authority approval. At this time, the DEQ portion of the application
fees will have to be paid directly to the state. For fastest processing, this is done electronically with the emails
provided on the application. DEQ should notify applicants with instructions on how to pay fees. When DEQ
approves the application, they will issue a permit coverage letter (may issue a revised permit coverage letter). This
should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference.
Applicants must complete the request for a pre -construction conference form, and pay the remainder of the
application fee. (Although land disturbance has occurred with WPO201800044 Amendment #1, given scope of
change from Amendment #1 to Amendment #2, a (virtual) preconstruction meeting to discuss ESC-SWM design is
warranted.) The form identifies the contractor and responsible land disturber, and the fee remaining to be paid. This
will be checked by county staff, and upon approval, a pre -construction conference will be scheduled with the County
inspector. At the pre -construction conference, should everything proceed satisfactorily, approval to proceed with
work (grading, ESC measures, improvements, and SWM facilities shown with Amendment #2) may begin.
