The Special Exception was approved by the Board's adoption of the attached Resolution and Conditions. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: • compliance with the approved SPECIAL EXCEPTION; and • approval of a ZONING CLEARANCE. Should you have questions regarding the above -noted action, please contact me. Sincerely, Lea Brumfield Senior Planner II WWW.ALBEMARLE.ORG 401 McIntire Road, North Wing, I Charlottesville, VA 22902-4579 RESOLUTION TO APPROVE SPECIAL EXCEPTION FOR SE2021-00046 2558 OLD LYNCHBURG ROAD HOMESTAY WHEREAS, upon consideration of the Memorandum prepared in conjunction with the SE2021- 00046 2558 Old Lynchburg Road Homestay Application and the attachments thereto, including staff's supporting analysis, any comments received, and all of the factors relevant to the special exception in Albemarle County Code §§ 18-5.1.48 and 18-33.9, the Albemarle County Board of Supervisors hereby finds that the requested special exception would cause (i) no detriment to any abutting lot and (ii) no harm to the public health, safety, or welfare. NOW, THEREFORE, BE IT RESOLVED, that in association with the 2558 Old Lynchburg Road Homestay, the Albemarle County Board of Supervisors hereby approves the special exception to permit the use of an accessory structure built after August 7, 2019 for a homestay on a parcel over five acres in the Rural Areas zoning district, subject to the conditions attached hereto.
