I don't see a need for step 6. If the trail is built in accord with the initial LOR no new LOR is needed. If the trail is built differently than shown in the LOR it will be caught with the easement plat. The easement plat will serve as an LOR. William D. I've cleared this with Francis, but because you said that planning runs the Site Plan portion of zoning ordinance I wanted to get your take before I send my comments to the applicant. The order of what Francis and I came up with is below, based upon the attached proffer, and I think it is aligned with what was previously discussed with you. Please let me know if you see an issue with below. 1. An LOR is approved showing the proposed trail improvements but not easement. 2. The trail is built. 3. The trail is surveyed (and it is ensured it meets all the minimum requirements). 4. The easement plat is revised to show the exact location of the 6' easement over the true location of the trail. A maintenance agreement is drafted and approved with owner of the parcel maintaining the trail. The easement plat is approved and then both the plat and the agreement are recorded. 5. The CO for the building can be issued. 6. A second LOR, showing the trail easement, is submitted and approved.
