The permitted uses of the Property are provided in Section 25 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). The Property is subject to the Airport Impact and Entrance Corridor Overlay Districts described in Section 30 of the Zoning Ordinance. • The Property is subject to the multiple approved site plans, the most recent for Parcel ID 46134-2 is SDP2009-00001 "Food Lion (Timberwood Blvd) — Minor.", for Parcel ID 46134- 8 is SDP2001-00034 " The Shops at Forest Lakes Final," and for Parcel ID 46134-10 is SDP2003-00087 "Forest Lakes Terrace Final." It appears the Property has been developed in accord with these plans. • There are no additional conditions, variances, or special use permits associated with the Property. • To the best of my knowledge, the Property is currently in compliance with all applicable requirements of the Zoning Ordinance. A review of our files found (i) no violations or alleged violations or regulations applicable to the Property, whether pending, contemplated, or having already occurred and (ii) no fees due or pending with respect to any matter before the County Zoning Office; and (iii) no pending application for rezoning or for a special or conditional use permit or variance of the Property. Further, no proceeding to challenge the zoning or other governmental approval or use of the Property is pending or overtly threatened to the best of our knowledge. • There are no requirements such as mandated improvements that are triggered by a change of ownership. • In the event of a casualty, in whole or in part, the structure located on the Property may be built in its current form subject to the approval of a building permit and applicable site plans and building code. February 21, 2022 LZC2022-00014 Page 2 • There is one Certificate of Occcupancy (CO) for Parcel ID 46134-10, no other parcel has a CO for the structure on file in the Community Development Department Records Public Access. Requests for those file may be made as instructed below. • Copies of any relevant records may be obtained via the noted links or the Community Development Department Records Public Access link below.
