The County of Albemarle Planning Division will recommend approval of the plat referenced above once the following
comments, and those provided by other Site Review Committee, SRC, members, have been satisfactorily addressed. The
following comments are those that have been identified at this time. Additional comments or conditions may be added or
eliminated based on further review. [Each comment is preceded by the applicable reference to the Albemarle County
Code.]
1. [14-302(A)(3), 14-400] Private street. Show and provide the location, width, and name of the private street that
provides primary access and frontage to revised parcel TMP 71-33134. Rev. 1: Comment not fully satisfied. The
revised plat identifies Wild Berry Lane as a "30ft Access Easement". Provide the deed book and page reference
for the recorded instrument that created this easement.
2. [14-309, 14-4161 Confirm that no primary or reserved drainfields lie within Parcel X. Rev. 1: Comment addressed.
Thank you for providing this information. Staff has confirmed that the primary and reserve drainfields for the
proposed residue of TMP 71-33C is not within the area to be transferred and combined to TMP 71-33134. This
information can be removed from the final plat.
3. [14-312] Provide the distance between the Shed on TMP 71-33C and the proposed parcel boundary. Rev. 1:
Comment addressed.
4. [Comment] What does the line running north -south directly behind the Shed structure on TMP 71-33C represent?
Rev. 1: Comment addressed. The revised plat dated November 26, 2021 identifies this line as a fence.
5. [14-302(A)(9)] Building site. Revise Note 3 to explicitly state that "Revised parcel TMP 71-33134 and residue parcel
TMP 71-33C each contain a building site that complies with Section 4.2.1 of the Albemarle County Zoning
Ordinance." Rev. 1: Comment addressed.
6. [10.4] Setbacks. Rev. 1: Comment addressed.
a. Revise Note 2 to clarify the following setbacks (no changes are needed to the side and rear setbacks
listed):
i. Front (existing public road) = 75ft
ii. Front (internal public or private road) = 25ft
b. Revise the front setback line depicted on the plat map such that it is 75ft from the property line abutting
Burchs Creek Rd.
7. [14-303(D)] Acreage. State the total acreage of each existing and proposed lot. Rev. 1: Comment addressed.

8. [14-302(A)(7)] Abutting parcel information. It appears there is a clerical error on the plat. Please review and revise
the tax map and parcel ID for the lot north of TMP 71-33134. Rev. 1: Comment addressed.
9. [General Comment] Reminder that revised plats must include the original date of drawing and the revision date(s)
of each subsequent version of the plat. Rev. 1: Comment still valid.
10. [14-302(A)(10)] Rev. 1: Note 8 must identify the number of development rights currently assigned to each
existing parcel and how many development rights are being transferred by this boundary line adjustment. An
acceptable revised note could read as: "Residue parcel TMP 71-33C is assigned one (1) development right and
may not be further divided. Revised parcel TMP 71-33134 is assigned two (2) development rights and may be
further divided. One (1) development right is being transferred with Parcel X. When used, this development right
shall be within the December 1980 boundaries."
Note: Staff research found one (1) development right currently assigned to TMP 71-33B4. Therefore, when/if
Parcel X is combined and added to TMP 71-33134, the revised parcel will have two (2) development rights. Staff
suggest the applicant research to verify these findings.
In accordance with the provisions of Z.O. 14-229 of the County Code, if the applicant fails to submit a revised plat to
address all of the requirements within six (6) months after the date of this letter, the application shall be deemed to have
been voluntarily withdrawn by the applicant.
