We have a number of questions and comments which we believe should be addressed before we can recommend favorably on your SP request. We would be glad to meet with you to discuss these issues. Review comments are provided below, organized by Department, Division, or agency. Comments from the Planning Division are provided first: Planning— General Special Use Permit Comments 1. Revise both the concept plan and the project narrative to include the application number assigned to this project, SP2021-00005. 2. Clarify how many of the 50 participants at each session are expected to be staff, and how many are expected to be children/youths. 3. Clarify if the drop-off and pick-up times for the participants are included in the 9am-4pm timeframe, or if they are slightly earlier/later. 4. How many busses or carpools are expected to be used each day? And are the busses proposed to remain on site all day, or would they drop off campers, and return later in the day to pick them up? 5. Transportation and traffic impacts of this use are an important consideration, given that Batesville Road is currently a gravel surface. See additional comments related to traffic and transportation later in this letter from the County's Transportation Planner and VDOT. 6. Provide additional information in the narrative on what is proposed when inclement weather occurs during the camp sessions. For example, where is it proposed that the participants will go when a thunderstorm arrives? 7. On the concept plan, please elaborate on the area that is identified as "expansion." I am confused as to what that label is identifying or what is proposed within the "expansion" area. 8. Will the residents of the house on the property use the driveway that is slightly farther to the west, with the longer driveway to the east being reserved for the camp attendees? 9. Provide more detail on the proposed parking area for camp leaders and the turn -around for the bus/cars that are dropping off and picking up the youth participants. (See also the comments in the attached memo from Francis MacCall, Chief of Zoning, regarding the proposed parking area and bus turn -around, as well as comments later in this letter from Howard Lagomarsino of AC Fire -Rescue regarding emergency access.) 10. Clarify the label of the arrow that is pointing to the area near number "6" — it did not copy well on the concept plan and is difficult to read. 11. What is the semi -circle of squares near number " 7" symbolizing? It was not clear to me. 12. Advisory Comment: A frill list of proposed conditions for this special use permit will be provided prior to the Planning Commission public hearing. Possible conditions on the special use permit would involve limits on sound and lighting, as well as conditions related to the operation of the use. Such operational conditions may include limiting the number of participants to the 50 requested in the application, limiting the days and hours of operation, and limits on the traffic expected to be generated by the use, such as by requiring a bus as proposed in the narrative. 13. Advisory Comment: If approved by the Board of Supervisors, the day camp use will be subject to the supplemental regulations found in 18-5.1.05 of the Zoning Ordinance (httvs://library.municode.com/va/albemarle county/codes/code_of ordinances?nodeld=CH18Z0_ARTBBARE_ SSSURE S5.ISURE S5.1.05DACABOCA). 14. Advisory Comment: A site plan (prepared by a licensed engineer) will be required if the special use permit is approved by the Board of Supervisors. This plan is required to show any improvements made to the site, such as for the entrance and parking areas necessary for operation of the use on the site. However, there are criteria in the County Code (httvs://library.municode.com/va/albemarle_county/codes/code_of ordinances?nodeld=CH18Z0_ARTIVPR S3 2SIPL S32.3AD) that allow for varying or excepting certain requirements of a site plan, which may be appropriate for this site, since the majority of the property will not be disturbed or be subject to any type of grading or construction. The construction of the proposed future pavilion would also be subject to the site plan requirement. 15. Advisory Comment: A community meeting with nearby residents and property owners is required prior to a public hearing with the Planning Commission. Scheduling for this community meeting is currently underway. Plannin¢ — Comments on Consistency with the Comprehensive Plan Initial comments on how your proposal generally relates to the Comprehensive Plan are provided below. Comments on conformity with the Comprehensive Plan are provided to the Planning Commission and Board of Supervisors as part of the staff report. Link to the Comprehensive Plan (https://www.albemarle.org/home/shQWublisheddocument?id=5667). The Comprehensive Plan designates both subject TMPs (85-3A and 85-3A1) as Rural Areas. Chapter 7 of the Comprehensive Plan discusses the Rural Areas of the County. This chapter identifies several objectives of the County to support the rural areas and encourage conservation of natural resources and preservation of agricultural and foresty operations. In addition, on page 7.5 of the comp plan, there is a list of standards that uses should be able to meet when proposed in the Rural Areas. The ability of this proposed use to meet these standards will be an important part of staffs analysis and recommendation in the report prepared for the Planning Commission and the Board of Supervisors. Criteria for Review of New Uses As new uses are proposed in the Rural Area, it is essential that they be able to meet the following standards. New uses should: • relate directly to the Rural Area and need a Rural Area location in order to be successful, (e.g., a farm winery has to be located in the Rural Area and would be unlikely to succeed in the Development Areas); • be compatible with, and have a negligible impact, on natural, cultural, and historic resources; • not conflict with nearby agricultural and forestal uses; • reflect a size and scale that complements the character of the area in which they will be located; • be reversible so that the land can easily return to farming, forestry, conservation, or other preferred rural uses; • be suitable for existing rural roads and result in little discernible difference in traffic patterns; • generate little demand for fire and rescue and police service; • be able to operate without the need for public water and sewer; • be sustainable with available groundwater; and • be consistent with other Rural Area policies. The proposed use of a nature -based day camp appears to be able to meet most of the standards listed above, as it is a use that relates directly to the Rural Areas and would be unlikely to succeed in the Development Areas. It also is not expected to conflict with nearby agricultural and forestal uses. (See staff report prepared for the AFD committee meeting held on March 16, 2021, for more information.) It is also not expected that the use will generate demand on public facilities such as fire, police, or utilities. In addition, as minimal new construction or land clearing is proposed with this use, it is anticipated that it will be easily reversible to later permit other rural uses, such as agriculture and forestry, or even have these uses occur simultaneously with the camp. However, information provided about the proposed use's expected suitability for existing rural roads could be strengthened. As a gravel road, Batesville Road is not at the same standard as more heavily traveled roads in the County that are paved with asphalt. With an increase to 50 proposed participants in the camp, it is anticipated that additional traffic would be generated from current levels during the times of the year when the camp would be in session. Staff recognizes the applicant's proposed use of busses and carpools to help mitigate impacts of the day camp use on the nearby traffic patterns and street network. However, it would be helpful to provide additional information on the details of this proposal, such as the number of busses and/or carpools expected each day, as well as the pick-up and drop-off times. (See comments from Transportation Planning and VDOT below.) Comments from Other Reviewing Divisions. Departments, and Aeencies Plannine - Transportation The following comments regarding this proposal have been provided by the County's Senior Transportation Planner, Daniel Butch, dbutchngalbemarle.org: Transportation Planning: Anticipated trip generation - Provide the number of total daily trips expected to generate from the 50 people. Provide trips by carpooling, bus and single use vehicles expected and break down trips by peak hours of pick up and drop off times. Confirm pick up and drop off times. Albemarle County Fire -Rescue (ACFR) The following comments regarding this proposal have been provided by the Fire & Rescue plans reviewer, Howard Lagomarsino, hlaQomarsinoCc�r�albemarle.org: 1) Emergency vehicle access is extremely limited based on the hand drawn concept plan. Fire and rescue emergencies will pose a challenge in reaching campers and staff in a fire, medical or other emergency situation. What fire, life safety and emergency plans are in placeor are planned? 2) It is difficult to determine on the hand drawn concept plan, does not appear emergency vehicles have adequatespace to stage or turn around. 3) Buidling Official's Office may have more to say on this issue, but using the increase in campers and staff may require additional measures to bring any building useage into compliance with codes, such as preparation of evacuation plans, installation of emergency equipment, access systems etc or even require to bring it up to code for a more intense use clarification but to assess appropriately, need clarification of use of buildings to support programs. Albemarle County Service Authority (ACSA) This SP is outside of the Albemarle County Jurisdictional Area. There are no comments. ACSA plans reviewer, Richard Nelson, melson@serviceauthority.org. Aericultural and Forestal Districts Advisory Committee (AFD) Meeting held with the AID Committee on March 16, 2021. By a majority vote, the committee voted to advise the Planning Commission and the Board of Supervisors that the proposed use does not conflict with the purposes of the Batesville Agricultural and Forestal District. Thank you for providing the email from Mr. Bedsaul stating your entrance meets the sight -distance requirements of a low -volume commercial entrance. Please provide the trip generation calculations to confirm that this entrance meets pre -requisite of a low -volume commercial entrance according to Section 4 of Appendix F of the Road Design Manual. 2. Note that the final plan must show conformance with the VDOT Road Design Manual Appendices 13(1) and F, as well as any other applicable standards, regulations or other requirements. State Code requires a 90-day review by the Planning Commission unless the applicant requests deferral. As you will read in this comment letter, staff recommends revisions to your project to help you achieve approval. Without these revisions, staff cannot recommend approval to the Planning Commission. If you would like to address the comments, you must request deferral by April 30, 2021. If you choose not to request deferral, staff will take your project to the Commission as originally submitted, but without a recommendation of approval. Instructions for requesting a deferral are outlined below. Please note that you can submit revisions even if you defer your application. Please do one of the following on or before April 30, 2021: (1) Request deferral to resubmit to address comments, pursuant to Section 33.52(A)(1). Resubmittals are usually accepted on the first and third Mondays of each month. The application fee which you paid covers staff review of the initial submittal and one resubmittal. Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.) Failure to Respond An application shall be deemed to be voluntarily withdrawn if the applicant requests deferral pursuant to subsection 33.52(A), and fails to provide within 120 days before the end of the deferral period all of the information required to allow the Board to act on the application.
