Miller School New Entrance
-BOS approved new entrance in Sept 1, 2010 with a condition.The mitigation plan must be implemented
before the entrance is open to the public
-The Mitigation Plan shall be approved and bonded prior to the issuance of an ESC permit for grading of
this entrance road.
-The mitigation plan is not yet approved and bonded.
-They submitted a ESC/mitigation/and road sheet and Phil reviewed the E&S Portion on May 25,2012. It
will be approved once his comments are satisfied. No SWM is necessary since there is no increase in ^ //

-They submitted a SDP plan and the new planner has to make a decision about the critical slopes waiver
and curb and gutter waiver.The travelway of 18'was dropped.
Current stage:
The applicant submitted a SDP plan and WPO plan on April, but they are the same set of plans. Phil
commented on SDP separately and WPO separately. The one I reviewed in 12/14/102 is the SDP only.
The WPO changed since applicant added more culverts, and reduced the slopes on road to reduce tree
wells.
The planner needs to decide if the waivers are approved or denied. If approved then they can pay a fee
to complete the E&S, mitigation plan, and road plans.They request a bond, post the bond, and attend a
precon.
Note-They have to implement mitigation plan first.
The Marine Core approved but should the applicant worry about the VMRC and CBPA
Advance comments for E&S Plans. Note that I reviewed the WPO so that when the applicant pays it will
be a quick turnaround.
1. Sheet C3.30. The storm pipe on station 36+50 does not match the 24"pipe.
2. Ensure all stormdrain pipes have at least a 2' cover
3. Check the check dam
4. No grading around the tree protection
5. Sheet 8.1 contours don't match
6. Check the check dams
7. The junction box detail on sheet C2.0 does not match the profile on sheet C3.0.

Dear Mr. Stallings:
This is in regard to your Department of the Army permit application number NAO-2012-
1312 to do work in an unnamed tributary of Miller Branch. The work involves installing and
replacing a culvert to construct a new entrance to the school. The work will occur on Miller
School property,Charlottesville,Albemarle County, Virginia. All work will be done according
to the attached drawings.
Your proposed work as outlined above satisfies the criteria contained in the Corps
Nationwide Permit(s)(18)attached. The Corps Nationwide Permits were published in the
February 21,2012 Federal Register notice(77 FR 10184)and the regulations governing their use
can be found in 33 CFR 330 published in Volume 56,Number 226 of the Federal Register dated
November 22, 1991.
Provided the project specific conditions(above)and the Nationwide Permit General
Conditions(enclosed)are met, an individual Department of the Army Permit will not be
required. In addition,the Virginia Department of Environmental Quality has provided an
unconditional §401 Water Quality Certification for Nationwide Permit Number(s) 18. A permit
may be required from the Virginia Marine Resources Commission and/or your local wetlands
board,and this verification is not valid until you obtain their approval, if necessary. This
authorization does not relieve your responsibility to comply with local requirements pursuant to
the Chesapeake Bay Preservation Act(CBPA), nor does it supersede local government authority
and responsibilities pursuant to the Act. You should contact your local government before you
begin work to find out how the CBPA applies to your project.
Enclosed is a"compliance certification" form, which must be signed and returned within 30
days of completion of the project, including any required mitigation. Your signature on this
form certifies that you have completed the work in accordance with the nationwide permit terms
and conditions.
This verification is valid until the NWP is modified,reissued, or revoked. All of the existing
NWPs are scheduled to be modified, reissued, or revoked prior to March 18,2017. It is
incumbent upon you to remain informed of changes to the NWPs. We will issue a public notice

when the NWPs are reissued. Furthermore, if you commence or are under contract to commence
this activity before the date that the relevant nationwide permit is modified or revoked,you will
have twelve(12)months from the date of the modification or revocation of the NWP to complete
the activity under the present terms and conditions of this nationwide permit unless discretionary
authority has been exercised on a case-by-case basis to modify, suspend,or revoke the
authorization in accordance with 33 CFR 330.4(e)and 33 CFR 330.5 (c)or(d). Project specific
conditions listed in this letter continue to remain in effect after the NWP verification expires,
unless the district engineer removes those conditions. Activities completed under the
authorization of an NWP which was in effect at the time the activity was completed continue to
be authorized by that NWP.
