Now that the property lines are depicted, it is clear that the proposed pool does not comply with Section 5.1.16. This section specifies that the, "... pool, including the apron, filtering and pumping equipment, and any buildings, shall be at least 75 feet from the nearest property line and at least 125 feet from any existing dwelling on an adjoining property..." In looking at the Phase 2 preliminary plat, it appears that there may be an area between Meadow Crossing Trail and parcel F that will be added to this site which will resolve the distance problem. If so, submittal of the plat for that exchange will satisfy Section 5.1.16. 2. There is no description of the 4-foot fence submitted as previously requested. Section 5.1.16 specifies that,"when the lot on which any such pool is located abuts the rear or side line of, or is across the street from, any residential destrict, a substantial, sightly wall, fence, or shrubbery shall be erected or planted, so as to screen effectively said pool from view from the nearest property in such residential district." If the fence is to be part of the screening, we need more information. If not, we need some other method of addressing the screening. 3. A new parking schedule is shown on this revision, but no figures regarding square footage of clubhouse and pool were provided. We need these figures to justify the parking. Please have the applicant either revise the plan to include that information or send a letter directly to me. 4. Condition number 5 of the rezoning for Ashcroft (ZMA-80-03) was that either the Hansen house or the Lego house be provided as the clubhouse. Since the Lego house has been sold and the Hansen house was destroyed, we are in accord with the applicant that this is the best alternative currently available. There was correspondence in 1991 between the Homeowners Association, the Planning Department and the applicant in which staff agreed with the applicant that to construct a new clubhouse facility on the site of the Hansen Studio would be consistent with condition 5. This plan preserves some of the historic and beautiful setting surrounding the former Hansen house and artists studio by using the same area sculpted by J. R. R. Hansen. The Zoning Administrator by this memorandum is confirming and making this an Official Determination of compliance. Under Virginia Code Section 15.1.496.1, if you or any aggrieved party disagrees with this determination you may appeal this decision within thirty days of the date of this memorandum by filing with this office a written notice of appeal to the Board of Zoning Appeals.
