Sarah Baldwin From: Long, Valerie [vlong©williamsmullen.com] Sent: Friday, August 23, 2013 1:50 PM To: Sarah Baldwin Subject: RE: Elledge Tower Sarah, thank you for this information. I am not surprised that the waiver is being pulled from the consent agenda, but am surprised to hear that it might go to the PC. Can you explain why that might be? Thank you, Valerie From: Sarah Baldwin [mailto:sbaldwin@albemarle.org] Sent: Friday, August 23, 2013 11:28 AM To: Long, Valerie Subject: Elledge Tower Valerie: I wanted to give you an FYI that the critical slopes waiver is going to get pulled from the consent agenda onto the regular for Sept. 11tn Also, I am getting conflicting information on how the County Attorney's Office wants to handle the waiver. It is possible it might have to go to the PC as well. As soon as I hear anything, I will let you know. Thanks. Sarah D. Just a brief question, if the answer is evident from a map. Are the towers in Belair and Colthurst somewhat more removed from the populations there --perhaps near the edge of the subdivisions? I recall, too that the acreage of lots is rather large in those neighborhoods, possibly leaving most neighbors farther removed from the towers than would be the case in Key West. Thanks. -Bob Toplin On Fri,Aug 16,2013 at 9:35 AM, Sarah Baldwin<sbaldwin@albemarle.org>wrote: I was able to do some checking but not of the whole County. This is essentially the same exact application approved by the Planning Commission in 2010 — a Tier 2 facility at 103 feet, in the exact same location. Since then the trees have grown, and we had our engineers re-measure trees, and the pole is just 3.8 feet above the reference tree (it was 7 feet when approved in 2010). We have included the additional landscaping to screen the base of the ground equipment from the Clem and Sinclair residences as well. The one difference is that when we had the engineers re-survey the site to provide current plans, they obtained more precise critical slope data on site and determined that the area of critical slopes being disturbed is actually larger than originally thought. It was thought to be 409 square feet of total disturbance in 2010, but now is 2,316. Still a very small fraction of the total parcel, and a fairly small disturbed area. I have included a detailed critical slope waiver request with the application. We will be reaching out to the neighbors and Mr. Sinclair very to discuss the proposal, but I wanted to make you aware of it right away, for we expect there will be interest in the proposal. Please let me know if you have any questions. If you would like us to meet with the Planner to provide background, I would be happy to do so. The original application was handled by Elizabeth Marotta. I have also alerted Ken Boyd and Cal Morris. Thank you, Valerie Valerie Wagner Long Williams Mullen 1
