RE: Response Letter #2 for SUB2021-113 Proffit Road Townhomes South
Dear Cameron,
Thank you for your review of the subdivision plat for Proffit Road Townhomes South. This letter contains
responses to County comments dated December 1, 2021.Our responses are as follows:
1. [ ZMA201800019] Per proffer # 2 of ZMA201800019, access easements must be provided to
TMP 046134- 00-00-005AO and TMP 03200-00-00-029D0. These access easements should be
provided where proposed private streets connect to these two adjacent parcels.
a. Planning staff is working with the County Attorney's Office to obtain a template for the
private access easement agreement. This may be a separate deed that will need to be
recorded with the final plat, or it may be in some other form of instrument. The
instrument template will be provided to the applicant at a later time once it has been
drafted. Rev. 1: Comment stands. Staff correspondence with applicant via email on
August 4th informed applicant that the County Attorney's Office has stated that the
property owner is responsible for drafting private access easement agreement per
the proffer. No draft of the easement agreement was submitted with the second
submittal of the plat. Please provide a copy of the draft with the next plat submittal,
and include a completed version of the attached checklist.
Deed of Easement is attached with this submission.
3. 14- 302 ( B)( 1)] Please add a date of last revision. Rev. 1: Comment stands.
The Plat contains the date of the last revision.
12. [14-311, 14-410, 14-412, 14-422] Prior to final plat approval, road plan application must be
approved. Road plans are currently under review, application number SUB202100124. Rev. 1:
Comment stands, road plans SUB202300124) not yet approved. See attached Engineering
Division comments for further information.
We understand that the Road Plan must be approved prior to Plat approval.
14. 1 14-317] Instruments evidencing maintenance of certain improvements required as part of the
final plat approval. The instrument must address all requirements specified in subsections of
Section 14- 317 of the Subdivision Ordinance. Features that require instruments identifying
ownership and maintenance responsibilities are as follows:
a. All open space parcels to be owned by the HOA.
A copy of the HOA declaration is attached with this submission.

b. All private easements, including the proposed private street easements.
A copy of the HOA declaration is attached with this submission.
c. If the applicant will provide a draft of HOA covenants to cover these items, the County
Attorney's office has asked that the applicant complete the HOA Covenant checklist that
is attached to this comment letter. Submit a copy of the completed checklist with the draft
covenants, if applicable.
Rev. 1: Comment stands. Applicant comment response letter states "Noted." In
response to this comment. No drafts of deeds of easement or private improvement
maintenance agreements were included with the submittal of the revised plat.
A copy of the HOA declaration is attached with this submission.
17. [ 14-431] Please see attached Engineering Division comments. All proposed public stormwater
and drainage easements will require a deed of dedication to be recorded with the plat. Deed
templates will be drafted by Engineering Division staff and provided to the applicant once all
substantive revisions to the plat have been addressed. Please contact the Engineering Division
directly for questions related to stormwater and drainage easement deeds. Rev. 1: Comment
stands, see attached Engineering Division comments for further information.
We requested a draft of the deeds from engineering in the comment response letter.
18. [ 14-434 and 14-435] Prior to final plat approval, all on -site improvements required by the
Subdivision Ordinance must be completed ( built) or bonded. This includes stormwater
management facilities, drainage facilities, and streets. Rev. 1: Comment not fully addressed.
See engineering comments for further information regarding approvals and bonding
required prior to final plat approval.
Comment noted. As soon as the Road Plan is approved by Engineering, the Road bond will
be posted.
