ON 3-09-2022 To: Kirk Hughes, L.S., Kirk Hughes & Associates (kirk@khals.net ) From: Mariah Gleason Division: Community Development - Planning Date: March 9, 2022 Subject: SUB202200019 Windie Knowe - Boundary Line Adjustment (BLA) The County of Albemarle Planning Division will recommend approval of the plat referenced above once the following comments, and those provided by other Site Review Committee, SRC, members, have been satisfactorily addressed. The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review. [Each comment is preceded by the applicable reference to the Albemarle County Code.] 1 1. [14-302(A)(10)] Development rights. Staff have researched the subdivision history of both subject properties and found a different number of development rights. Staff believe TMP 62-69A currently has six (6) development rights and TMP 62-88 currently has two (2) development rights. Please follow up with staff if you believe this to be incorrect. If you agree with staff on the number of development rights and the applicant wishes to transfer one development right with Parcel C-1, then Note C should be revised to state: 'Revised Tax Map 62, Parcel 69A is assigned 7 development rights and may be further divided. When used, these development rights shall be within the December 1980 boundaries. The residue of Tax Map 62, Parcel 88 is assigned 1 development right and may not be further divided. One development right is being transferred with Parcel C-1." (REVISED NOTE) ITS NOT THE PURPOSE OF THIS BLA TO MAKE A DEVELOPMENT RIGHT DETERMINATION. THAT WOULD BE UNDER A SEPARATE APPLICATION. 1 2. [14-302(B)(5)] Zoning. Tax Map 62, Parcel 88 is subject to the Entrance Corridor Overlay District. This information can be included in Note A. Please revise the note to state: "Current Zoning: RA (Rural Areas); Tax Map 62, Parcel 88 is subject to the Entrance Corridor Overlay District" (REVISED NOTE) 1 3. [14-302(A)(9)] Building site. Note D on Sheet 2 should address the resulting parcels. Please revise the note to state: "Revised Tax Map 62, Parcel 69A and the residue of Tax Map 62, Parcel 88 each contain a building site that complies with Section 4.2.1 of the Albemarle County Zoning Ordinance." (REVISED NOTE) 1 4. [14-302(B)(7)] Watershed. Revise Note E to make it clear that the Upper Rivanna River Watershed is not a water supply watershed of Albemarle County and/or City of Charlottesville. (REVISED NOTE) 1 5. [14-302(A)(15)] Conservation easement. Per Albemarle County GIS, TMP 62-69A is located within a conservation easement. Please add a note stating that TMP is subject to a conservation easement, state the recorded instrument number for any instruments recorded with the Circuit Court Clerk associated with the easement, and state the name and address of the conservation easement holder in a note on Sheet 2. (ADDED NOTE) 1 6. [14-302(B)(10)] Stream buffers. Locate existing stream buffer areas on TMP 62-69A and TMP 62-88. This information could be added to the Map Key provided on Sheet 1. (ADDED BUFFERS) 1 7. [14-303(D)] Acreage. Please state the acreage of the residue of Parcel C in the label on Sheet 3. The label should state "Residue of Parcel C measuring ___ acres, to remain a portion of TMP 62-88." (REVISED LABEL) 1 8. [14-303(H)] Boundary lines. Revise the plat map on Sheet 3 to label the distances on northwest and southeast corners of Parcel C-1 from property corners, being in the roadway, to the IRS locations. (THEY ARE CORRECTLY LABELED) 1 9. [Comment] Albemarle County GIS indicates a different owner for TMP 62-71 than indicated on the plat map on Sheet 3. Please update the owner and information for this parcel as appropriate. (UPDATED OWNERS) 1 10. [Comment] Reminder that revised plats must include the original date of drawing and the revision date(s) of each subsequent version of the plat. (ADDED REVISION DATE) In accordance with the provisions of Z.O. 14-229 of the County Code, if the applicant fails to submit a revised plat to address all of the requirements within six (6) months after the date of this letter, the application shall be deemed to have been voluntarily withdrawn by the applicant.
