The Special Use Permit was approved by the Board's adoption of the attached Resolution and Conditions. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: • compliance with the approved SPECIAL USE PERMIT; • approval of and compliance with a SITE PLAN; and • approval of a ZONING COMPLIANCE CLEARANCE. Sincerely, Mariah Gleason Senior Planner II Planning Division CC: Tap Investments LLC 2903 North Augusta Str Staunton VA 24401 WWW.ALBEMARLE.ORG 401 McIntire Road, North Wing, I Charlottesville, VA 22902-4579 RESOLUTION TO APPROVE SP202100003 CALIBER COLLISION WHEREAS, upon consideration of the staff report prepared for SP 202100003 Caliber Collision and the attachments thereto, including staffs supporting analysis, the information presented at the public hearing, any comments received, and all of the factors relevant to the special use permit in Albemarle County Code §§ 18-24.2.2(17) and 18-33.8(A), the Albemarle County Board of Supervisors hereby finds that the proposed special use would: I . not be a substantial detriment to adjacent parcels; 2. not change the character of the adjacent parcels and the nearby area; 3. be in harmony with the purpose and intent of the Zoning Ordinance, with the uses permitted by right in the Highway Commercial zoning district, with the regulations related to body shops in § 18-5.1.31, and with the public health, safety, and general welfare (including equity); and 4. be consistent with the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED that the Albemarle County Board of Supervisors hereby approves SP 202100003 Caliber Collision, subject to the conditions attached hereto. *ss I, Claudette K. To be in general accord with the Conceptual Plan, development must reflect the following essential major elements: • Building footprint • Parking areas 2. Development also must reflect the following additional major elements: • A Fourteen (14)-foot wide planting strip • An Eight (8)-foot wide shared use path constructed of permeable pavement (subject to existing easements and other site constraints) Minor modifications to the plan that do not conflict with the elements above may be made to ensure compliance with the Zoning Ordinance.
