See below and attached for conditions and process. This approval shall be valid for a period of five (5) years from the date of this letter, provided that the developer submits a final plat for all or a portion of the site within one (1) year after the date of this letter as provided in the Section 14-226 of the Code of the County of Albemarle, and thereafter diligently pursues approval of the final plat. The final plat will not be considered to have been officially submitted until the following items are received: 1. A final plat that satisfies all applicable requirements of the Subdivision Code, and the conditions attached to this letter. 2. Applicable fee outlined in the application. Please submit the final plat to the Community Development Department. The assigned Lead Reviewer will then distribute the plats to all reviewing agencies. [ZMA202100004; 14-302 (B)(5)] Per the proffers and Concept Plan development standards of ZMA202100004, there are required improvements in open space areas throughout Breezy Hill. This includes all trails and pathways through the open space. Additionally, there are required improvements in the tot lot that includes a variety of recreational equipment. Prior to final plat approval, a site plan application must be submitted and approved that shows all amenities required by the ZMA, including: a. All required primitive trails, pedestrian trails, and multi -use paths as required by the Concept Plan and proffers of ZMA202100004. b. All proposed improvements within the tot lot and pocket park. 2. [14-302 (A)(4); 14-302 (A)(5)] All existing public and private easements must be shown and labeled on the final plat with dimensions and the recorded instrument number of the plat that created the easement. 3. [14-302 (A)(13)] Please show all proposed easements for grading and drainage on the final plat. Label the easements as public or private, and state their dimensions. See Engineering Division comments for further information. 4. [14-302 (A)(14)] Please state the acreage of public right-of-way that is proposed to be dedicated to public use as a note on the cover sheet of the final plat. 5. [14-302 (A)(15)] Please state the address of the owners of each existing parcel as a note on the final plat. 6. [14-302 (A)(16)] Note 9 indicates that the property is located within a state dam break inundation zone (DBIZ). Please show and label the limits of the DBIZ on the plat. 7. [14-302 (113)(5)] On the final plat, please provide separate notes for each TMP that is to be subdivided that identifies the primary zoning district, all applicable zoning districts, and any special use permits or zoning map amendments that apply to the TMP. 8. [14-302 (B)(30)] Please add a note stating "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance." 9. [14-303 (A)] On the final plat, please add a statement of consent to division for each property proposed to be subdivided. The note should be worded as follows: "The platting or dedication of the following described land [insert a correct description of the land subdivided] is with the free consent and in accordance with the desire of the undersigned owners, proprietors and trustees, if any." 10. [14-303 (C)] The final plat must show the exterior boundary lines of each existing and proposed property with bearings in degrees, minutes and seconds. Curvilinear data shall include radius, central angle, arc length, and tangent distance. All dimensions shall conform to the standards set forth in this chapter. 11. [14-303 (D)] On the final plat, state the acreage of existing TMP, and provide a note calculating the residue acreage of each parcel. 12. [14-303 (E)] Please provide all linear, angular, and curvilinear dimensions of lots, streets, alleys, public easements and private easements and shared driveways shall conform to the requirements set forth in 8 VAC 10-20-370(C), a copy of which shall be on file in the department of community development. Curvilinear data shall include radius, central angle, arc length, and tangent distances and may be shown either directly on the corresponding boundary or surveyed line or in table form. Easements shown for private streets, alleys and shared driveways shall be labeled as "private street easement', "alley easement' or "shared driveway easement" 13. [14-303 (G)] Please state who will own all proposed open space/common areas. 14. [14-303 (H)] Please identify the location and material of all permanent reference monuments. If any monument required by this chapter will be installed after recordation of the final plat, the certification of the professional engineer or land surveyor shall so note. 15. [14-303 (L); 14-431] All public easements will need a deed of dedication to be recorded with the final plat. Engineering staff will draft the deeds during final plat review. 16. [14-303 (M)] Please see attached E911 comments. All proposed street names must be approved by E911 prior to final plat approval. Street names must be shown on the final plat. 17. [14-303 (0)] Please provide a signature panel for each property owner on the final plat. a. The signature panel for the owner shall be located immediately below the statement required by comment #10 above. 18. [14-303 (P)] Provide notary panels next to the statement of consent to division for each parcel mentioned in comment #18. 19. [14-303 (Q)] Please provide a statement as to whether the subdivision will be served by a public water supply and a public sewer system. 20. [14-303 (S)] Please identify at least four control points evenly distributed across the property and located at survey property corners, and shown on each sheet depicting the property. 21. [14-311] Prior to final plat approval, a Water Protection ordinance (WPO) plan must be approved. See Engineering Division comments for further information. 22. [14-302 (13)(5); 14-316] Per notes on the cover sheet of the ZMA202100004 Concept Plan, notes must be provided on the final plat and road plans stating the following: a. "Secondary vehicular access point at Running Deer Drive is to be installed prior to issuance of the 31'' building permit. The vehicular access at Running Deer Drive shall be an emergency access only unless a full vehicular access is required by VDOT." b. "All construction traffic shall enter/exit the site through the main entrance on Route 250 and will not be permitted to use the entrance at Running Deer Drive." 23. [14-311; 14-316; 14-4341 Prior to final plat approval, a road plan application must be submitted, reviewed and approved all the following must be addressed: a. [14-311] Approval of a road plan application is required prior to final plat approval. Please see attached VDOT and Fire Rescue comments for further information. b. [ZMA202300004; 14-410; 14-411; 14-422] Proposed streets must meet the design standards specified on the Concept Plan and by proffer #1f. c. [ZMA202300004] Street trees must be installed along all interior roadways and along Route 250 as noted on Sheet 1 of the ZMA202100004 Concept Plan. d. [14-434] All roads must be built or bonded prior to final plat approval. 24. [14-414] Prior to final plat approval, applicant must obtain approval from ACSA for all proposed water and sewer utilities. 25. [14-426; 14-302 (A)(14)] On the final plat, please add a note stating that the public street right-of-ways shown hereon are dedicated to Albemarle County for public use. The following comments will need to be addressed with the final plat (or plans submitted prior to final plat): 1. Per County Code 14-302 B-10, please add the following note to the plan, 'The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance." 2. Please note that final plat cannot be approved until: a. WPO VSMP Plan is approved. b. Roads are built or bonded. c. FDP Plan is approved for grading and improvements within the 100 -yr flood plain. d. All applicable easements are shown, labeled, and match approved plans. e. If development will be phased, please ensure final plat shows phase lines. 3. [Sheets V8-V13] Please label proposed contours. 4. [Sheets V8-V13] Please label proposed right-of-way dimensions. 5. Please note that cul-de-sac radii must meet VDOT and Fire Rescue standards. These cul-de-sacs appear too small; VDOT and ACFR typically request 48' R cul-de-sac for fire rescue apparatus access. Cul-de-sac design will be evaluated with the road plan. 6. Proposed grading within the floodplain required to construct cul-de-sac (at end of road C) will be compared with requirements listed at 18-30.3.11(table) Permittedand prohibited uses and structures, with the road plan. 7. Per County Code 14-302-A-13 and 14-305, please show the location of proposed drainage and stormwater management facilities and related improvements. 8. Recommend show rectangular building site, Lot 19, given extremely irregular lot lines. 9. It appears driveway and structures maybe in roadway embankment on lots 42, 61, 69, 6, 79, 80. VDOT may have certain restrictions on what is allowed. Roadway design will be reviewed with the road plan by Engineering /VDOT. 10. Per proffers dated 5/7/21 and Breezy Hill rezoning concept plan dated 3/12/21, revised most recently 8/5/21, please anticipate future roadway grades required to connect Breezy Hill development with future adjacent subdivision development. One example to consider is the grading shown on Lots 18 and 19. It appears to yield residential structures with first floor elevations that would be below eventual future roadway grade. If the buildings are less than 30 feet tall, then this fire apparatus access road shall be no less than 20 feet wide, unobstructed. If the buildings are to be over 30 feet tall, than the minimum, unobstructed width is 26 feet. Is the right of way proposed sufficient to fulfill this requirement? 2) The dead ends require an approved turn around for fire apparatus if the length to the dead end exceeds 150 feet. A cul de sac satisfy the requirement, but must provide a 96 ft diameter. It does not appear the proposed righyt of way layout on the plat is sufficient for this. 3) The turn radii are specified by the fire and emergency apparatus in use within the jurisdiction. Generally for our jurisdiction, 25 ft. turn radii satisfy the turn radius for our units. Add a note: "VDOT will only maintain within the drainage easements to the extent required to protect the road." 2. Add a note: "Landscaping plants and trees adjacent to the sight distance triangle will need to be maintained in an area between 2 and 7 feet above ground as a clear zone to preserve sight lines and accommodate pedestrians." 3. Approved road plans meeting SSAR, and in compliance with the VDOT Road Design Manual are required prior to plat approval. 4.
