Hi Neil,
Now that I've had a chance to review the plat, I can answer your questions. In your original email you cite comments
from one reviewer of the ZMA that took place midway through the ZMA application process. Please know that I, as well
as all other members of the Site Review Committee (SRC), can only enforce whatever the Board of Supervisors approved
with the ZMA, in addition to any other development regulations from the County Code. The Application Plan and
proffers that were approved by the BOS on October 6, 2021. We reviewed the preliminary plat, and the short answer is
that it complies with the approved ZMA and all other development regulations that apply at this time. The
applicant/developer still has to go through a road plan, Water Protection Ordinance (WPO) and final plat application
review process before any construction can begin (road plans/WPO) and lots actually created (final plat).
That said, here are answers to your original questions:
Question 1— Sheets V8 through V13 show the new lots, streets, and proposed grading together on the same drawings.
No existing preserved slopes are being disturbed.
Question 2 - Note 15 on Sheet V1 states that all of the properties are subject to ZMA202100004. This is the standard
way that proffers are identified on plats here in Albemarle County, and indicates to all staff reviewing the plat to make
sure that the proffers are complied with when reviewing actual construction plans for the project (road plans and Water
Protection Ordinance plans).
In regard to the following — lots 6, 7, 20, 42, 61, 79, 80 do not encroach into any of the stream buffer, preserved slopes,
or slopes greater than 25%. Lots 18 and 19 also do not encroach into any critical slopes or preserved slopes. Lots 18 and
19, although it appears close when looking at the drawing, do not encroach into the stream buffer. Staff from the
Engineering Division, who administer the Water Protection Ordinance, reviewed and evaluated the drawings and the lot
layout as proposed does not violate the ZMA or other development regulations related to the buffer.

Back to the present day and the plat currently under site review: It appears to me that several proposed lots violate
that stipulation. See Lots 42 & 61 on v8,

I'm asking that County Staff please make sure this apparent conflict is resolved. I'm copying this email to Cameron

Attached you will find the comment letter from the Site Review Committee (SRC) for the Breezy Hill Preliminary

There is only one comment that needs to be addressed prior to approval of the preliminary plat, and that is to pay the
remaining balance of the application fee. This is comment #1 in the letter.
I am required to take action on the plat by Friday, March 18`h so the remaining fee will need to be paid by then. Please

The 2"1 comment is a definite yes.
Comment #1- the approved proffers identify several future street interconnections as being required. The concept plan
referenced in the proffer statement (attached) is not uploaded to County View, so I'm going to have to dig for it and
figure out where exactly those connections were anticipated. Take a look at the proffer statement and let me know your
thoughts.

There is a Zoning Map Amendment that was approved recently by the County Board of Supervisor's for the project. A
proffer was approved with it that limited the total number of units that are allowed to be developed in Breezy Hill to 80
units overall. I just took a look at the preliminary plat that was submitted (I haven't began my actual review yet), and it

appears they are proposing 80 units. So this would be the full build out allowed under the conditions of the rezoning
that apply to the project.

staff and Albemarle County Fire & Rescue, are reviewing the application for compliance with all applicable road design
standards. I have not yet begun review of this one myself, as I have over a dozen other applications ahead of it in my
review queue. If there are deficiencies with the current proposal not being in compliance with County or State
requirements for road design, the proposal will have to be revised accordingly prior to approval of a road plan
application (which actually allows road construction) or a final subdivision plat application (which allows lots to be
created).

to have tree/scrubs added along it. This is only 50' road for both traffic directions.
It looks like they could design the road "D" to direct more of the traffic toward their Rt250 entrance for safety reasons,
since this is a residential area, houses with children close to the road and farm animals in a field adjoining it.

zero rush on this but I had come questions on Breezy Hill. Is "Road A" the existing Breezy Hill Ln? Or is it in any way
attached, etc? Road D looks like it does not connect to Hearns Ln in anyway correct?

memo regarding this application —there is not going to be a meeting to discuss this project. Staff from the Site Review
Committee will review the plans and issue comments directly to the applicant. The comments will be available online
sometime after March 4".
