In your original email you cite comments from one reviewer of the ZMA that took place midway through the ZMA application process. Please know that I, as well as all other members of the Site Review Committee (SRC), can only enforce whatever the Board of Supervisors approved with the ZMA, in addition to any other development regulations from the County Code. The Application Plan and proffers that were approved by the BOS on October 6, 2021. We reviewed the preliminary plat, and the short answer is that it complies with the approved ZMA and all other development regulations that apply at this time. The applicant/developer still has to go through a road plan, Water Protection Ordinance (WPO) and final plat application review process before any construction can begin (road plans/WPO) and lots actually created (final plat). That said, here are answers to your original questions: Question 1— Sheets V8 through V13 show the new lots, streets, and proposed grading together on the same drawings. No existing preserved slopes are being disturbed. Question 2 - Note 15 on Sheet V1 states that all of the properties are subject to ZMA202100004. This is the standard way that proffers are identified on plats here in Albemarle County, and indicates to all staff reviewing the plat to make sure that the proffers are complied with when reviewing actual construction plans for the project (road plans and Water Protection Ordinance plans). In regard to the following — lots 6, 7, 20, 42, 61, 79, 80 do not encroach into any of the stream buffer, preserved slopes, or slopes greater than 25%. Lots 18 and 19 also do not encroach into any critical slopes or preserved slopes. Lots 18 and 19, although it appears close when looking at the drawing, do not encroach into the stream buffer. Staff from the Engineering Division, who administer the Water Protection Ordinance, reviewed and evaluated the drawings and the lot layout as proposed does not violate the ZMA or other development regulations related to the buffer. Comment #1- the approved proffers identify several future street interconnections as being required. The concept plan referenced in the proffer statement (attached) is not uploaded to County View, so I'm going to have to dig for it and figure out where exactly those connections were anticipated. If so, who might make such comment. Engineering? Others? Eliminate most cul-de-sac grading on Lots 18, 19 via retaining walls such that, should future connection with adjacent parcel be requested or required, such connection may be built and tie to roadway grade that will of necessity be relatively flat between Lots 18 and 19. Proposed grade shown on Lots 18 and 19 is certain to yield residential structures with FFE well below eventual future roadway grade. Please anticipate roadway grade required in the future to connect Breezy Hill development with future subdivision development to the NW. Refer, 19 for example, to anticipatory design, V 11, for extension of not only grading but a paved surface to exterior parcel boundary, between lots 3 and 4. Viewpoint that floodplain or stream buffer issues may prevent future connection between Road C cul-de-sac and adjacent parcel entails risk since presence of buffer or floodplain has not prevented crossings to make or enhance inter -parcel connections required by Zoning. A proffer was approved with it that limited the total number of units that are allowed to be developed in Breezy Hill to 80 units overall. I just took a look at the preliminary plat that was submitted (I haven't began my actual review yet), and it 27 appears they are proposing 80 units.
